Section 9~ This agreement is subjec~ to and incorporates the attached Parts II and I~I, as if written word for nord herein. Section lOz The Contractor agrees to assist the Grantee in complying with all af the Conditions Governing Grants under the National Energy Conservation Policy Act. Section 11: The continued performance of this contract by the Grantee is dependent upon the availability of funds for this purpose. Should funds for this purpose cease to be available, this contract shall automatically termi~ate. Section 12~ Honesty and Fidelity Bonds. ~le Contractor shall maintain thraughout the duration of this Contract a Honesty and Fidelity bond that .protects the program against theft, damages, or other abuses that may occur while this contract is in farce. Such Honesty and Fidelity bonds should be at least 15Z of the total funds awarded under this Contract. The Grantee 'recommends that the~ contractor also maintain liability l~surance to protect against personal injury and property damage sustained during waatherizsiton activities. Section 13: ~estherization Program Mane ag~ is designated as "Contract Administrator" with the responsibilities of monitoring the activities of the contractor with respect to its implementation of the program in accordance with the provisions outlined in parts I, II and III, and in certifyiug that work has been performed hefere invoices sro paid. Section 14; The Contractor certifies that neither the organization nor any of its principals is presently debarred, suspended, proposed for debarment, declared lueligible, or voluntarily excluded fram participating in this Agreement by any Federal department ar agensy. Section 15; The Contractor certifies that it will comply with prohibitions and requirements fmc disclosure and certification relatsd to lobbying on recipients af Federal contracts, grants, cooperative agreements, and loans as conts~ed in the Federal Register iOCFR 601.
