CONTRACT TO PROVIDE T~-X DISTRICT FIRE SERVICE NORTH CAROLINA CABA~RUB COUNTY This contraot, made and entered into this 1st day of July, 1990, by and bet-'eon the VOLUNTEER FIREDEPARTMENT, Inc., a nonprofit corporation, and the County of Cabarrus; WITNESSETH: ThaC for and in consideration of the mutual covenants hereinafter contained, and pursuant to authority granted by G.S. 69-25.5, G.S. 69-25.6, and G.S. 153A-233, the VOLUNTEF-K FIRE DEPARTMENT and the County of Cabarrus do hereby covenant and agree as follows: 1. The County of Cabarrus agrees to annually levy and collect upon all taxable property lying within the Cabarrus County boundaries of the. Rural Fire Protection Tax District an ad valorem property tax equal to cents per one hundred ($100.00) valuation, and after deduction of the County's administrative charge (5%) for collection of such taxes, to pay the same to the _Volunteer Fire Department Inc. All monies collected will be paid to the fire department regardless of actual dollars budgeted. An additional supplement in the sum of $250.00 per month shall be payable as specified in the Cabarrus County Fire Protection Resolution. 2. The . ¥OLb'NTEER FIRE DEPARTMENT agrees to furnish and provide continuing fire protection service to all property lying within the boundaries of the Rural Fire Protection Tax District by dispatching upon call any or all of its equipment and adequate personnel to operate sa~e. 3. The Tax Collector of the County of Cabarrus shall, collect the ad valorem taxes so levied and shall make pa)~ment of the same to the VOLUNTEER FIRE DEPARTMENT monthly as collections are made. 4. The ' VOLUNTEER FIRE DEP~TMENT agrees to operate within the guidelines setforth in the Cabarrus County Fire Protection Resolution, attached to this cdntract. 5. This contract may be terminated by either party at the end of any fiscal year by giving 90 days written notice of its intent to so terminate to the other party. In witness whereof the VOLD~TEER FIRE DEPARTMENT, Ina. has caused these presents to be signed by its President and attested to by its Chief, and the County of Cabarrus has caused these presents to be signed by its Chairman and attested by the Clerk of its Board of Commissioners.
