COUNTY OF CABARRUS CONTRACT ~ ;.. THIS AGREEMENT, mede and entered by and between ua referred to as "cOUNTY", and LUTHERAN FAMILY SERVICES IN NORTH CAROLINA, INC. hereinafter referred to as "LUTHERAN SERVICES" is effective from July 1, 1990 through Juno 30, 1991. WITNESSETH ~{EREAS, The County, through its Departmont of Sociel Services hereinefter referred to as "DSS", is in need of emergency homes to receive children placed in the custody of DSS by the Courts, voluhtary plecements, or otherwise; and ~EREAS, Lutheren Services has egreed to osteblish one (1) emergency receiving home for such children; and ~ ~VHEREAS, Lutheren Services has had considerable experience in caring for children end is licensed by the State Of North Ceroline to opereto and maintain the emergency recoiving homo contempleted by this contrect. NOW, THEREFORE, in consideretion of the premises and the sums to be peid by the County to Lutheran Services, the Lutheren Services does hereby contract with the County to provide services of the type hereinafter described and upon the following terms and conditions: 1. Lutheran Services shall meintein one eround-the-clock emergency home in Concord, North Ceroline for the sole and exclusive use of DSS. The home shall provide edequate core end supervision for not more then five (5) children at all times, and DSS may place such children in the home as DSS, in its sole discretion, deems edviseble. 2. Lutheran Services shell provide room, board, adequate house parent steff supervision, routine school supplies, and allowances for children placed in the home. Lutheran Services shall provide transportetion for eech child to and from school. 3. Lutheren Femily Services will provide on a timely basis budget information Co Cabarrus County Department of Sociel Services as required by CBA and the County; proposed yeerly budget by Januery 2, 1991, budget emendment by June 10, 1991, and final accounting report by July 20, 1991. 4. The County shall pay to Luthoren Services the sum of $11,288.00 per month co meintein seid home, co provide food, shelter, and services herein contemplated. The County will provide clothing es determined by DSS. 5. The County through DSS will sign the edmission agreement at the time of plecement of a child. 6. The County shall be responsible for the pa)nment of any medical expenses incurred by any child placed in the home other than routine first aid administered by the emergency home; provided, Lutheran Services may euthorfze emergency medical treetment by licensed physicians should circumstences require. Reimbursement for medtcel services sro limited to Mod icaid covereRS only. 7. The County egress thet it will not request Lutheran Services to serve any one child in :he emergency receiving home for a period in excess of 90 deys, it being contempleted by both parties thet the child will be removed from the emergency facility as soon as a plan for long range plecement of the child has been developed. 8. The County through DSS shell hove the right to inspect the premises of the home at any reesonable hour in order to escertein thet the children placed in the group home are receiving adequate care; and Lutheren Services egress to secure and meintein all licenses necessary to operate the facility and to notify the agency ~odfately upo~ the loss of any required license or provisionel license status.
