Box 27687 Raleigh, North Carolina 27611 Dear Mr. Wilms: Hopefully I will have been able to talk with you on ~ telephone about this, but just in case that I have not been able to contact you I am going to ex~lain the status of the M~orandum of A~3re~ment between the State and ~.~c-kle-nburg County to perform m water quality manag~-~_nt program in ~cklenburg County. As I told you when w~ met last in your off/ce, I have requested that th~ County Attorney, F~-vin Bethune, review the proposed ~kmorand~n of Agr~ent to perform a ~ter quality manage~--nt program in M~-klenburg County and at the same ~ I have sent to Assistant County Manager F~rie Shook a ~-quest for Board Action to have this agreement placed on the August 18, 1986 County Cc~nission Meeting.. On August 5, 1986 I received a version of the ~orand~n of Agree~_nt fkxmt our County Attorney ~lich contained minor modifications. In talking with ~lr. Bethune, it appears that he had no problems with the concept as proposed in our latest draft, h~ver he did want to ~odify the M~orandum of ~t to more closely reflect the o~3anizational structure of ~L:~.klenburg County. ~erefore you will notice in the enclosed document that the preamble or agree~-nt section has been r~ritten to take into consideration that in Mecklenburg County the Board of C~m~ssioners exercise the power of the Board of Health. That in essence is the major revision that %~s ~ade of the · agreement. Other revisions are as follo~. Under the scope section M~rvLn reorganized the paragraph slightly to begin with "D~ does not relinquish any of its responsibilities, powers or authority by the execution of this agree~-nt." Other changes ~ch ~re made under the scope portion of the agre~went seem to be limited to reversing Sections 5 and 6 in the order. Under coordinat/on of activities, he reworde~ the first sentence slightly to read "The staffs of D~ and the Boar~ will ,make all reasonable efforts to coordinate act/rifles." I don't see that this reflects any change in the coocept which w~ had originally proposed. Finally, the other change of wording ~ms in the Section on the last page entitled Groundwater Protectiom.
