V. Reporting Duties <br /> Submit reports to DEH concerning articles 1-Iv above. <br /> <br />VI. Work Plan Duties <br /> <br /> Sub. it a work plan to DiM on an Annual basis containing a <br /> description of the methods, procedures, and protocols to be <br /> used and the responsibilities for both D£~ and the Board of <br /> Wealth. <br /> <br />Penalties <br /> <br /> The D£M shall retain exclusive authority and responsibility <br /> for the assessment of administrative penalties or for instituting <br /> legal action for violation of state statutes and regulations. <br /> <br />Coordination Of Activities <br /> <br /> The staff of DE~I and the Board of Health will make all reasonable <br /> efforts to coordinate activities. When coordination is not possible <br /> nothing will preclude either DEl4 or the Board of Health from <br /> conducting its activities unassisted. In this instance, activities <br /> will be coordinated as soon as possible after the activity. <br /> <br />Follow-up Activities <br /> <br /> All problems or violations of environmental laws or regulations <br /> found that are the responsibility of DiM shall be reported to and <br /> coordinated through the DiM regional office. <br /> <br />Groundwater Protection <br /> <br /> It is understood that this agreement and the portocols which will <br /> be developed will not preven: the Board of Hea!thf~a setting up <br /> and performing a local groundwater protection program within the <br /> jurisdiction of Cabarrus County. <br /> <br />Termination <br /> <br /> The DE~ or the Board of Health~ without giving cause, may terminate <br /> this agreement by providing at least 60 days written notice. <br /> <br /> <br />
