V. Reporting Duties <br /> Submit re~orts to DE~ concerning articles l-IV above. <br /> <br /> VI. Work Plan Duties <br /> <br /> Submit a york plan to DEM on an Annual basis containing a <br /> description of the methods, procedures, and protocols to be <br /> used and the responsibilities for both DEH and the Board of <br /> Health. <br /> <br />Penalties <br /> <br /> The DEH shall retain exclusive authority and responsibility <br /> for the assessment of administrative penalties or for instituting <br /> legal action for violation of state statutes and regulations. <br /> <br />Coordination Of Activities <br /> <br /> The staff of DFC4 and the Board of Health will make all reasonable <br /> efforts to coordinate activities. When coordination is not 9ossible ' <br /> nothing will preclude either DEM or the Board of Health from <br /> conducting its activities unassisted. In this instance, activities <br /> will be coordinated as soon as possible after the activity. <br /> <br />Follow-up Activities <br /> <br /> All problems or violations of environmental laws or regulations <br /> found that are the responsibility of DEM shall be reported to and <br /> coordinated through the DEH regional office. <br /> <br />Groundwater Protection <br /> <br /> It fs understood that thf~ agreement and the ~rtocols %h~c~ w~11 <br /> be ~veloped will not prevent the Board of Health f~ setting up <br /> an~ perfo~fng a local groundwater protection program within the <br /> jurfsdfctfo~ of Cabarrus County. <br /> <br />Termination <br /> <br /> The D~ or the 8oar~ of ~ealtha without giving cau~e~ may terminate <br /> this agreement by provlding at least 60 days written notice. <br /> <br /> <br />
