STAFF ANALYSIS - PETITION 90-12 <br /> <br />The analysis of this rezonin9 petition center on fundamental <br />questions. These questions are whether the zoning was <br />correct to begin with, and if not what the correct zoning <br />should be. In addition, there are some separate issues <br />which need to be discussed. <br /> <br />It was discussed, in another recent rezoning analysis that <br />the R-30 zoning was placed in this area primarily because of <br />two assumptions, the assumptions were that this area would <br />be incorporated into the urbanized areas of Concord and <br />Kannapolis and that water and sewer service would be <br />exlended to the area. Both of these assumptions appear now <br />to have been in error leaving the R-30 zoning inappropriate. <br /> <br />The slow pace of change in this area indicates the zoning <br />should mirror the historical and existing development of <br />this part of the County. The larger area is one of <br />agricultural, rural residential, and minor commercial uses <br />mixed with an abundant amount of open space. Hilton Lake <br />Road itself is primarily residential with one notable <br />commercial use and some vacant and wooded lots. The most <br />appropriate zoning for the entire area seems to be <br />Agricultural/Rural Residential. <br /> <br />There is some concern about the intrusion of ARR zoning onto <br />a single parcel of land on Hilton Lake Road. It would have <br />been preferable to have bad a petition for a single use, but <br />this application preceded the approval of Special Use <br />District zoning. <br /> <br />The fact that there is a residence on the property that will <br />continue lessens the concerns about thc possibilities for <br />problems under the ARR zoning. <br /> <br />The Staff feels that ~RR zoning is appropriate for this area <br />of the County, that the rezoning of this property will not <br />adversely affect adjoining properties, and that this <br />petition should be approved. <br /> <br /> <br />
