SECTION 4. GRANTING OF FRANCHISE: <br /> <br /> (a) upon receipt of an application for a franchise, the Board <br /> shall schedule a time and place for a hearing on the <br /> application. <br /> <br /> (b) The County shall, prior to the hearing, cause such <br /> investigation, as is deemed necessary to be made of the <br /> applicant and its proposed operations. <br /> <br /> (c) A franchise, shall be granted if the Board finds all of <br /> the following: <br /> <br /> (1) That the public convenience and necessity requires <br /> theproposed ambulance service. <br /> <br /> (2) That ~ach such ambulance and its required equipment <br /> have been certified by the State of North Carolina <br /> as acceptable for the type of franchise requested. <br /> <br /> (3) That the applicant or its officers or partners are <br /> responsible persons to conduct or work in the <br /> proposed business. <br /> <br /> (4) That only duly certified Emergency Medical <br /> Technicians are employed as operators and attendants <br /> by applicants for an ambulance service franchise. <br /> <br /> (5) That all the requirements of this ordinance and all <br /> other applicable laws and ordinances have been met. <br /> <br />SECTION 5. TERM OF FRANCHISE AND GEOGRAPHICAL BOUNDARIES: <br /> <br /> The Board shall issue a franchise hereunder to an ambulance <br />provider, to be valid for a term to be determined by the Board, <br />provided either party may, at its option, terminate the franchi~e <br />after written notice to the other party given at least six months <br />prior to the date of termination. The Board may terminate a <br />franchise only after holding a public hearing following publication <br />of a notice of hearing once a week for two successive weeks before <br />the hearing. <br /> <br /> No franchise granted may be sold, assigned or transferred nor <br />in any way rest in any person other than the applicant to whom the <br />franchise is granted. <br /> <br /> <br />
