m Page g of 15 <br /> <br /> m 18(a) of the Urban Mass Transportation Act of 1964, as amended, has <br /> m designated the North Carolina Department of Transportation as the agency to <br /> receive and administer federal funds under this program. <br /> m WHEREAS, in order to assist in providing incidental transportation <br /> <br /> services, the Department, under the terms of this Agreement shall make a <br /> grant of capital assistance to the COUNTY OF CABARRUS. <br /> <br /> NOW, THEREFORE, in consideration of the mutual covenants herein set <br /> forth, the Department and the Contractor agree as follows: <br /> <br /> m Section 1. Purpose of Agreement. The purpose of this Agreement is to <br /> provide for the undertaking of a nonurbanized area public transportation <br /> project (hereinafter referred to as "Project") by the Contractor and to state <br /> <br /> mthe terms, conditions, and mutual undertakings of the parties as to the <br /> manner in which the Project will be undertaken and completed. <br /> m Section 2. scope of Project. The Contractor shall undertake and <br /> complete the Project in accordance with the procedures and guidelines set <br /> forth in the Urban Mass Transportation Administration (hereinafter referred <br /> to as "U~KFA") Circular 9040.1B, dated July 1, 1988, the State Management <br /> Plan for the Section 18 Program (hereinafter referred to as "State <br /> <br /> mManagement Plan"), the Project Application and Transportation Development <br /> <br /> Plan for the COUNTY OF CABARRUS. The aforementioned documents, and any <br />m subsequent amendments or revisions thereto, are herewith incorporated by <br /> reference, and are on file with and approved by the Department in accordance <br />m with the terms and conditions of this Agreement. <br /> <br />m Section 3. Limitations of Project. This Agreement shall be subject <br /> to, and the availability of funds contingent upon, the terms and conditions <br />mof a grant agreement between the UMTA and the Department. <br /> <br />m <br /> <br /> <br />
