CAROLINAS ELECTRICAL CONTRACTORS ASSOCIATION of[ice ol

CHARLOTTE, NORTH CAROLINA 28211
Phone: (704) 365-4016

January 23, 1989

To: All North Carolina Boards of County Commissioners
Note: Please distribute to your County Commissioners
Gentlemen:

In its meeting December 8 and 9, 1988, the Association of Boards of County
Commissioners voted to support legislation which would abolish the Separate Contracts
law (G.S. 143-128) in construction.

We have had electrical contractors "spot-cheCk" various counties and county
conunissioners to determine the reasoning for this stand. To our surprise we discovered
that many counties and county commissioners were not aware of this proposal and in fact
did not favor a change to the existing law.

This letter is to both inform your county of such a proposal and to inquire as to whether
your county will Support such a move.

There are many reasons why the electrical contractors favor the retention of G.S. i43-128;
however, the one reason wldch we believe you nfight be interested in is our unified belief
that abolishment of this law will result in an increased cost to the taxpayer for construction
projects. We also believe that you would be interested in the fact that abolishment could
lead to less competition and in fact escalate the costs even further.

Should you desire additional information, please notify the writer.

Sincerely,
~ BoblNAS ELECTRICAL CONTIL,',.CTORS ASSN..
