Isenhour, Jr./Zoning Administrator-- <br /> Date: April 20, 1989 <br /> Subject: Ken Knight property off of Pitts School Road <br /> <br /> This is to update you on the legal action that this office has <br /> taken in the above referenced zoning, building, and health viola- <br /> tion. <br /> <br />On April 13, 1989 Mr. Gordon Belo, Zoning Attorney, and myself <br />were in Federal Bankruptcy Court seeking relief from the bankrupt- <br />cy court to allow this office to proceed with a lawsuit to correct <br />or discontinue the zoning, building, and health violation that <br />exist at the illegal apartments off of Pitts School Road being <br />directly behind the Pitts Fire Department and owned by Mr. Ken <br />Knight. At that hearing the Federal Judge stated that he would <br />allow thc County the right to negotiate with th~ attorneys for Mr. <br />Knight's parents, who have the power of attorney for the property, <br />since Mr. Ken Knight is in prison. He specifically stated that he <br />would not allow the County to take any action against the property <br />that would allow the discontinuation of the apartments while they <br />were paying off the bankruptcy. He further stated that if no <br />actions could be taken that would resolve the violations in the <br />future that he would be willing to hear from the case again. He, <br />however, declined to schedule a time for a future hearing and <br />basically left it up to the attorneys to try and work out an <br />arrangement that would correct the violations in a matter that <br />would not effect the profit making ability of the units. <br /> <br />If you dcsire further information please contact me at any time. <br /> <br /> <br />
