NORTH CAROLINA ORDER CLOSING EASEMENT DEDICATED <br />CABARRUS COUNTY FOR PUBLIC ROAD <br /> <br /> WHEREAS, at its meeting of April 10, 1989, the Board of <br />Commissioners of Cabarrus County (the "Board") acknowledged <br />a Petition to adopt a Resolution and Order closing the <br />approximately 1025-foot-long Nantucket Court located in No. <br />2 Township, Concord, Cabarrus County, North Carolina, as <br />more particularly described in Map Book 18, Page 64, of the <br />Cabarrus County'Registry, a copy of which is reproduced as <br />Exhibit A attached hereto (the "Road"), such request being <br />pursuant to North Carolina General Statute 153A-241; and <br /> <br /> WIIEREAS, the map dedicating Nantucket Court was <br />recorded in the Office of the Register of Deeds of Cabarrus <br />County on August 15, 1980, but Nantucket Court has never <br />been pla~ed under the control or supervision of the North <br />Carolina Department of Transportation; and <br /> <br /> ~IEREAS, at its meeting of April 10, 1989, the Board <br />adopted a Resolution declaring its intent to close the Road; <br />and <br /> <br /> WHEREAS, notice of said Resolution was published once a <br />week for four (4) successive weeks in the Concord Tribune, <br />Concord, North Carolina, notifying the public of a hearing <br />to be held before the Board on May 15, 1989, at 7:30 p.m., <br />or as soon thereafter as person~ miqht be heard: and <br /> <br /> WHEREAS, the Petitioner is the sole property owner <br />abutting the Road; and <br /> <br /> W~EREAS, such notice was prominently posted on at least <br />two (2) places along the Road; and <br /> <br /> WHEREAS, at its regular meeting in the Commissioner's <br />Room of the Cabarrus County Courthouse at 7:30 p.m. on May <br />15, 1989, the Board considered such Resolution; and <br /> <br /> W~I~REAS, at the meeting and hearing on May 15, 1989, <br />the Board considered all comments before it and determined <br />that the closing of the Road is not contrary to the public <br />interest, that no individual owning property in the vicinity <br />of the Road would be deprived of any means of ingress and <br />egress, nor would an individual owning property in the <br />vicinity of the Road be aggrieved by the closing of same. <br /> <br /> BE IT, THEREFORE, ORDERED that Nantucket ~Court, as <br />hereinbefore described, be and the same is hereby closed to <br />the public and, pursuant to North Carolina General Statute <br />153A-241, the title of the petitioner, the sole abutting <br />landowner, for the width of its abutting land, hereafter <br /> <br /> <br />
