COUNTY OF CABARRUS i .... ' ..... '; i <br /> <br /> THIS AG~E'~NT, made and entered by and between 0~'~8~';; h~reinafter <br />referred to as "CO~TY", and LUTHE~ F~ILY SERVICES' IN NORTH C~YN~; INC., <br />hereinafter referred to as "L~HE~ SERVICES" is effective from Ouly t, 1989 through <br />June 30, 1990. <br /> <br /> WITNESSETN <br /> <br /> WHEREAS, The County, through its Department of Social Services hereinafter <br />referred to as "DSS", is in need of emergency homes to receive children placed in the <br />custody of DSS by the Courts, voluntary placements, or otherwise; and <br /> <br /> WHEREAS, Lutheran Services has agreed to establish one (1) emergency <br /> receiving home for such children; and <br /> <br /> WHEREAS, Lutheran Services has had considerable experience in caring for <br /> children and is licensed by the State of North Carolins to operate and maintain the <br /> emergency receiving home contemplated by this contract. <br /> <br /> NOW, THEREFORE, in consideration of the premises and the sums to be paid by <br /> the County to Lutheran Services, the Lutheran Services does hereby contract with the <br /> County to provide services of the type hereinafter described and upon the following <br /> terms and conditions; <br /> <br /> 1. Lutheran Services shall maintain one around-the-clock emergency home in <br /> Concord, North Carolina for the sole and exclusive use of DSS. The home shall provide <br /> adequate care and supervision for not more than five (5) children at all times, and <br /> DSS may place such children in the home as DSS, in its sole discretion, deems <br /> advisable. <br /> <br /> 2. Lutheran Services shall provide room, board, adequate house parent <br /> staff supervision, routine school supplies, and allowances for children placed in the <br /> home. Lutheran Services shall provide transportation for each child to and from <br /> school. <br /> <br /> 3. Lutheran Family Services will provide on s timely basis budget <br /> information to Cabarrus County Department of Social Services as required by CBA and <br /> the County; proposed yearly budget by January 2, 1990, budget amendment by June 10, <br /> 199G, and final accounting report by July 20, 1990. <br /> <br /> 4. The County shall pay to Lutheran Services the sum of $10,463.00 per <br />month to maintain said home, to provide food, shelter, and services herein <br />contemplated. The County will provide clothing as determined by DSS. <br /> <br /> 5. The County through DSS will sign the admission agreement at the time <br />of placement of a child. <br /> <br /> 6. The County shall be responsible for the payment of any medical expenses <br />incurred by any child placed in the home other than routine first aid administered by <br />the emergency home; provided, Lutheran Services may authorize emergency medical <br />treatment by licensed physicians should circumstances require. Reimbursement for <br />medical services are limited to Medicaid coverage only. <br /> 7. II~e County agrees that it will not request Lutheran Services to serve <br />any one child in the emergency receiving home for a period in excess of 90 days~ it <br />being contemplated by both parties that the child will be removed from the emergency <br />facility as soon as a plan for long range placement of the child has been developed. <br /> 8. The County through DSS shall have the right to inspect the premises of <br />the home at any reasonable hour in order Lo ascertain that the children p%aced in the <br />group home are receiving adequate care; and Lutheran Services agrees to secure and <br />maintain al~ licens~ necessary to operate the facility and to notify the agency <br />immediately upon the loss of any ~qu~red_ license or provisional license status. <br /> <br /> <br />
