November 15, 1989 Deferred Compensation Plan Adminislrator Dear County Official: The Tax Reform Act of 1986, and the clarifying Technical and Miscel- laneous Revenue Act of 1988 which the President signed into law on November 11, 1988, require changes in the existing Plan Document which governs your National Association of Counties Deferred Compen- sation Program. Enhancements have also been incorporated within the Plan Document resulting from the recent contract negotiations be- tween NACo and your Plan Administrator, PEBSCO. To keep your plan in compliance with Internal Revenue Code Section 457 regulations, these changes have been incorporated into your Plan Document by PEBSCO, Plan Administrator for the NACo program, with the approval of NACo. Additionally, PEBSCO made other revisions de- signed to make your Plan Document easier to read. Changes are ex- plained in detail on separate pages which accompany this letter. Also enclosed is a revised copy of the Administrative Agreement which required changes as a result of contract negotiations between PEBSCO and NACo. These changes are explained in detail on a sepa- rate page which accompanies this letter. It is extremely important for Internal Revenue Service compliance and contract purposes that PEBSCO have on file a copy of your ac- knowledgement of the Plan Document and Administrative Agreement changes. Once you have reviewed all changes, please acknowledge your acceptance by signing the Plan Document and Administrative Agreement and retuzn both pages as indicated to PEBSCO in the en- closed postage-paid envelope within 30 days. On the first page of the Plan Document, please insert your entity name in the appropriate area. Also, on the first page of the Administrative Agreement, in- sert your entity name and the date you sign the document.
