14, InEerest of Men, ers of the Program and Others. No officer, member, or employee of the Program. and no public official of any local government which is affected in any way by the Program, who exercises any function or responsibilities in the review of the Program or any compQnent part thereof, shall participate in any decisions relating ~o this contract which'afects his personal interest or the interest of any corporation, partnership or association in which he is, directly or indirectly,.intere~ted; nor shall any such person have any interest, direct or indirect, in this contract or the proceeds arising therefrom. 15, Officials not to Benefit. No member of or delegate to the Congress for the United States if America, resident Commissioner or employee of the United States Government, shall be entitled to any share or part of this contract or any benefits to arise herefrom. 16. Equal Employment Opportunity. (a) D.S.S. shall not discriminate against any employee, applicant for employment or subcontractor because of race, color, handicap~ religion, age~ sex, or national origin. D.S.S. shall take affirmative action to insure that applicants are employed and subcontractors (subContractors must be mutually approved) are selected, and that employees are treated during employment, without regard to their race, color, handicap, religion, age, sex or national origin. Such action shall include, but not be limited to the following: employment, upgrading, demotion, or transfers; recruitment advertising; layoffs or termination; rates of pay or other forms of compensati, selections for training including apprenticeship; and participation in recreational educational activities. D.S.S. certifies that it presently has in effect such an affirmative action program. D.S.S. agrees to post in a conspicuous place available to employees and applicants for employment, notices setting forth the provisions of the non-discrimination clause. D.S.S. shall in all solicitations or advertisements for subcontractors or employees placed by or on behalf of D.S.S. state that D.S.S. is an "Equal Opportunity Employer". (b) D.S.S. shall keep such records and submit such reports concerning characteristics of applicants for employment and employees as the Council and the North Carolina Division of Aging may require. (c) D.S.S. agrees to comply with such guidelines as the North Carolina Division of Aging may issue to implement the requirements of the paragraph. (d) The Center agrees to comply with Title VI and Title VII of the Civil Rights Act and Section 504 of the Rehabilitation Act. 16a~ Indemnity and Insurance. The D.S.S. agrees to indemnify and save harmless the Parchaser, its agents and employees from and against any and all loss, cost, damages, expense and liability caused"by the failure of the Center to fully perform its obligations under this agreement and in accord with its terms; er by an accident or other occurrence causing bodily injury, including death, sickness and-disease to any person; or damage or destruction to property, real or personal, which may arise from operations, products or services rendered under this contract.
