14, InEerest of Men, ers of the Program and Others. No officer, <br /> member, or employee of the Program. and no public official of <br /> any local government which is affected in any way by the Program, <br /> who exercises any function or responsibilities in the review <br /> of the Program or any compQnent part thereof, shall participate <br /> in any decisions relating ~o this contract which'afects his <br /> personal interest or the interest of any corporation, partnership <br /> or association in which he is, directly or indirectly,.intere~ted; <br /> nor shall any such person have any interest, direct or indirect, <br /> in this contract or the proceeds arising therefrom. <br /> <br />15, Officials not to Benefit. No member of or delegate to the <br /> Congress for the United States if America, resident Commissioner <br /> or employee of the United States Government, shall be entitled <br /> to any share or part of this contract or any benefits to arise <br /> herefrom. <br /> <br /> 16. Equal Employment Opportunity. <br /> (a) D.S.S. shall not discriminate against any employee, applicant for <br /> employment or subcontractor because of race, color, handicap~ religion, <br /> age~ sex, or national origin. D.S.S. shall take affirmative action to <br /> insure that applicants are employed and subcontractors (subContractors <br /> must be mutually approved) are selected, and that employees are treated <br /> during employment, without regard to their race, color, handicap, religion, <br /> age, sex or national origin. Such action shall include, but not be limited <br /> to the following: employment, upgrading, demotion, or transfers; recruitment <br /> advertising; layoffs or termination; rates of pay or other forms of compensati, <br /> selections for training including apprenticeship; and participation in <br /> recreational educational activities. D.S.S. certifies that it presently <br /> has in effect such an affirmative action program. D.S.S. agrees to post <br /> in a conspicuous place available to employees and applicants for employment, <br /> notices setting forth the provisions of the non-discrimination clause. <br /> D.S.S. shall in all solicitations or advertisements for subcontractors <br /> or employees placed by or on behalf of D.S.S. state that D.S.S. is an <br /> "Equal Opportunity Employer". (b) D.S.S. shall keep such records and <br /> submit such reports concerning characteristics of applicants for employment <br /> and employees as the Council and the North Carolina Division of Aging <br /> may require. (c) D.S.S. agrees to comply with such guidelines as the <br /> North Carolina Division of Aging may issue to implement the requirements <br /> of the paragraph. (d) The Center agrees to comply with Title VI <br /> and Title VII of the Civil Rights Act and Section 504 of the <br /> Rehabilitation Act. <br /> <br />16a~ Indemnity and Insurance. The D.S.S. agrees to indemnify and <br /> save harmless the Parchaser, its agents and employees from and <br /> against any and all loss, cost, damages, expense and liability <br /> caused"by the failure of the Center to fully perform its obligations <br /> under this agreement and in accord with its terms; er by an <br /> accident or other occurrence causing bodily injury, including <br /> death, sickness and-disease to any person; or damage or destruction <br /> to property, real or personal, which may arise from operations, <br /> products or services rendered under this contract. <br /> <br /> <br />
