~rtiele II <br /> <br /> Pretreatment and Surcharge Program Agreement <br /> <br /> Section A- Pretreatment Pro,ram <br /> <br /> 1) The~agrees to provide~ implement~ and maintain an approved <br /> Prctreatmcnt Program as required by state and federal laws and <br /> regulations for the control of non-domestic discharges. <br /> <br /> 2) As part of the Pretreatmen~ Pbogram, the4;i~Wlll adopt a~Sewer <br /> Use Ordinance that contains the ~ondibions and limitations to be met by <br /> each non-domestic discharger in~luding Federal and State Pretreatment <br /> Standards. This will allow the2gl~ to deny or conditionally approve <br /> new or increased contribution of pollutants and to establish <br /> requirements for existing sources. Thc Ordinance shall establish the <br /> requirements for filing an application for a Permit to discharge non- <br /> domestic wastewater into the Rocky River Regional Wastewater System. <br /> The Ordinance will alao establish the following authorities: <br /> <br /> a) The Ordinance shall require existing non-domestic users <br /> develop a oompliauce schedule for the installation of technology <br /> necessary to meet Pretreatment Standards and to submit self- <br /> monitoring reports. <br /> <br /> b) Thc Ordinance will give the s~a~f~f--~he-,G4~o~ the authority <br /> to. carry out insp~ctions~ surveillances and monitoring procedures <br /> necessary to determine nomplianee. This shall include the right <br /> to enter an non-domestic user's premises to examine records of <br /> monitoring activities. ~* o~k~, <br /> c) The Ordinance will allow the g~y~t se k injunctive relief <br /> for nonsompliance and to seek and assess civil penalties for <br /> noncompliance. ~' <br /> <br /> d) The Ordinance will give the~ui.~-the authority to halt or <br /> prevent any discharges that present or are likely to present an <br /> imminent danger to health~ the environment~ or that threaten to <br /> interfere with the operations of the Rocky River Regional <br /> Wastewater Treatment Plant. <br /> <br /> 3) The.County~ agrees to require~ by ordinance~ that all non-domestic <br /> dischargers; existing and future file an Application for Permit <br /> directly with thc ~t4~ and to comply with all other provisions of the <br />~, ~-~-- City~ Sewer Use Ordinance. <br /> <br /> ? <br /> <br /> <br />
