CABARRUS COUNTY
Post Of[ice Box 707
Concord, North Carolina 28026-0707

MEMORANDUM
TO: Charles D. McGinnis/County Manager

FROM: F.E. Isenhour, Jr./Zoning Administrator..?,. ~
Jame~ F. Oweos/PIaoning Directo~ ~.~.'~,~.

January 27, 1988

SUBJECT: Zoning Regulations and Enforcement within the City of
Kannapoiis Corporate Limits.

gurlng the past weeks our offices have become increasing aware of
circumstances that may bear heavily on the abiiity of The County
of Cabarrus to continue zoning requirements and enforcements
within the Corporate limits of the City of KannapolJs. Since the ~(n
incorporation of the City of Kannapolis in December of 1985, our
offices have provided numerous services during the transition of
governmental services between the County and City. Recently the
County Zoning Staff and County Planning Staff have found them-
selves in a very difficult situation trying to balance the desires
of the County through its countywide planning tools, with the
perceived desires of the City of Kannapolfs. We have a very
difficult situation in regulating/enforcing the desires of the
County in an area where the governing board and planning board
have little input into the decision making process that effects
the future planning of the City of Kannapolfs.

Also, we have recently started having increased problems with
individuals and/or businesses and corporations receiving informa-
tion that vary from both jurisdictions. This has lead to misin-
formation and the possibility of continued misinformation being
given to the public by both units of government. We feel that to
stop any major problems before they have a chance to fully mature,
that one of the two jurisdictions involved must take total respon-
sibility for the planning and zoning regulations for the City of
Kannapolis. We also feel that planning and zoning regulation and
enforcement should be carried out by the governing body and plan-
ning board that will have eventual control of the City.

Due to the amount of growth now being experienced in the outlying
areas of Cabarros County, the staff time for the Cabaerus County
Planning and Zoning Department is increasingly needed within the
unincorporated parts of Cabarrus County. Therefore, we would like
to recommend that the Cabarrus County Board of Commissioners
