ARMSTRONG and <br />KANNAPOLIS POLICE DEPARTMENT, : <br /> <br /> Defendants: <br /> <br /> MEMORANDUM OPINION AND ORDER <br /> <br />W~KD, Chief Judge <br /> <br /> This matter came before the Court on February 1, 1988 for <br /> <br />trial of plaintiff's civil rights claim under 42 U.S.C. <br />~ !983, PurSuant to a Warrant issued December ~8, 198~, <br />defendant Armstrong arrested plaintiff on May 30, 1983 and <br />charged him with obtaining money and property by false pretenses <br />in violation of N.C.Gen.S~at. ~ 14-100. Plaintiff ~ow asserts a <br />civil rigbts claim challenging the warran~ as not supported by <br />probable cause. Finding that probable cause existed that <br />plaintiff made an additional misrepresentation beyond the <br />presentation of a worthless check, the Court will gran~ judgment <br />in favor ~f d~fendants. <br /> <br /> DISCUSSION <br /> <br /> The fourth amendmeDt provides in pertinent part that "no <br /> <br />Warrants shall issue, but upo~ probable cause .... " <br /> <br />U.S. Co,st. amend. Iv. Consequently, plaintiff contends ~hat the <br />arres~ warrant issued ia this case fails to pass constitutional <br />muster in that no probable cau'se existed for an offense under <br /> <br /> <br />
