Final drafts of legal documents dedicating and <br /> restricting the common areas and establishing a Home <br /> Association or similar organization. <br /> <br />SECTION 3.7 PHASED ~EVELOPMENTS <br /> <br />If a developer' proposes that a subdivision Cincludin'g <br />planned developments) will be constructed In phases, the <br />lollowlng procedure shall apply: <br /> <br />A. A master plan a~owlng the entire proposed subdivision <br />and phases of development, proposed density, proposed type <br />and location of util.ities, end proposed development <br />timetable shall be Submitted to the Planning Board for <br />approval. <br /> <br />B. Each phase of development shall be preceded by <br />submission end approval of a preliminary plat ss outlined in <br />Section 3.4. The master plan may be submitted prior to or <br />simultaneously to submission of the preliminary plat for the <br />first phase of development. <br /> <br />C. AND OTHER .LAWS <br /> <br />All subdivisions and lots crested under this ordinance must <br />comply with the requirements of the Cabarrue County Zoning <br />Ordinance end other applicable State and local laws. <br /> <br />SECTION 4.2 SUITABILITY ~ THE LAND AND CONFORMITY <br /> <br />A. Lands which ere subject to flooding, excessive erosion, <br />or slides because of soil types or groups, water courses and <br />other drainageways, steep elopes, or other hazards shell not <br />be platted for residential or other uses in such e way es to <br />present a danger to lite, property, or to the public health, <br />safety, or general welfare. <br /> <br />B. A subdivider proposing to use an existing lake or to <br />construct a new leks must structurally upgrade or construct <br />the lake and dam or provide other satisfactory means for <br />accommodating the runoff within the watershed. The dam <br />shall be designed and built to accommodate the runoff from a <br />twenty-four (24) hour, one hundred (100) year frequency <br />storm.
