FLOOD DAMAGE PREVENTION ORDINANCE <br /> <br /> ARTiClE I. STATUTORY AUTHORIZATION, FINDINGS OF FACT, <br /> PURPOSE AND OSJECTiVES. <br /> <br />SECTION A. STATUTORY AUTHORIZATION <br /> <br />The legislature of the State of North Caroline has in <br />Chapter t53A-t2t of N. C. General Statues, delegated the <br />responsibility to local governmental units to adopt <br />regulations designed to promote the public health, safety, <br />and general welfare of its citizenry. Therefore, the County <br />Commissioners of Ceberrus County, North Carolina, do ordain <br />as follows: <br /> <br />SECTION B. FINDINGS OF FACT. <br /> <br /> t. The flood hazard areas of Caberrus County are <br />subject to periodic inundation which results in loss of life <br />and property, health end safety hazards, disruption of <br />commerce end governmental services, and extraordinary public <br />expenditures for flood protection end relief, and impairment <br />of the tax base, ell of which adversely affect the public <br />health, safety, and genernJ welfare. <br /> 2. These flood losses are caused by the cumulative <br />effect of obslructJons in floodplains causing increases in <br />flood heights and velocities, and by the occupancy in f toed <br />hazard areas by uses vulnerable lo floods or hazardous <br />to other lands which are inadequately elevated, <br />fioodproofed, or otherwise unprotected from flood damages. <br /> <br />SECTION C. STATEMENT OF PURPOSE. <br /> <br />It is the purpose of this ordinance fo promote the public <br />health, safety sad general welfare end to minimize public <br />end private losses due to flood conditions in specif;c areas <br />by provisions designed to: <br /> <br /> I. Restrict and prohibit uses which are dangerous to <br />health, surety and property due to water or erosion or in <br />flood heights or velocities; <br /> 2. Require that uses vulnerable to floods, including <br />facilities which serve such uses, be protected against flood <br />damage st the time of initial construction; <br /> 3. Control the alteration of natural floodplains, <br />stream channels, end natural protective barriers which are <br />involved in the accommodation of flood waters; <br />a. Control filling, grading, dredging end other <br />development which may increase erosion or flood damage, end; <br /> S. Prevent or regulate the construction of flood <br />barriers which will unnaturally divert flood waters or which <br />may increase flood hazards to other lends. <br /> <br /> 1 <br /> <br /> <br />
