I. The Board of Adjustment ns established by Cabarrus <br /> County shall hear end decide appeals and requests <br /> for variances from the requirements of this <br /> ordinance. <br />2. The Board of Adjustment shell hoar end decide <br /> appeals when it is alleged there is an error in any <br /> requirement, decision, or determination made by the <br /> Zoning Administrator in the enforcement or <br /> administration of this ordinance. <br />3. Any person aggrieved by the decision of the Zuning <br /> Administrator or any taxpayer may appeal such <br /> decision to the Board of Adjustment. <br />4. Variances may be issued for the reconstruction, <br /> rehabilitation or restoration of structures listed <br /> on the National Register of Historic Pieces or the <br /> Stets inventory of Historic Places without regard <br /> to the procedures set forth in the remainder of <br /> this section except for Article 4, Section D, <br /> (8)(a) and (d), and provided the proposed <br /> reconstruction, rehabilitation, or restoration will <br /> not result in the structure <br /> 5. In passing upon such applications, the Board of <br /> Adjustmenta shall consider ell technical <br /> evaluations, all relevant factors, all st=nd&fda <br /> specified in other sections of this ordinance, end: <br /> <br /> e. the danger that materials may be swept onto <br /> other lands to the injury of others; <br /> b. the danger to life end property due to flooding <br /> or erosion damage; <br /> c. the susceptibility of the proposed facility end <br /> its contents to flood damage and thc effect of <br /> such damage on the individual owne~ ; <br /> d. the importance of the services provided by the <br /> proposed facility to the community; <br /> e. the availability of alternative locations, not <br /> subject to flooding or erosion de,nags, for the <br /> proposed facility; <br /> f. Ihc compatibility of the proposed usa with <br /> existing end anticipated development; <br /> g. the relationship of the proposed use to the <br /> comprehensive plan end floodplain management <br /> program for that area; <br /> h. the safety of access to the property in times <br /> of flood for ordinary and emergency vehicles; <br /> i. the expected heights, velocity, duration, rate <br /> of rise and sediment transport of the flood <br /> waters at the site, and; <br /> j. the costs of providing governmental services <br /> during end after flood conditions including <br /> maintenance and repair of public utilities end <br /> facilities such aa sewer, gas, electrical, and <br /> water ayatems, and streets and bridges. <br /> <br /> 9 <br /> <br /> <br />
