I ii I <br /> <br /> 1.4.2. Issue addenda as appropriate to interpret, clarify, or expand the <br /> Bidding Documents. <br /> <br /> 1.4.3. Attend the bid opening, prepare bid tabulation sheets, and assist OWNER <br /> in evaluating bids or proposals and in assembling and awarding contracts for <br /> construction, materials, equipment, and services. <br /> <br /> 1.5 Construction Phase - Administration of the Construction Contract <br /> <br /> During the Construction Phase, ENGINEER shall: <br /> <br /> 1.5.1. Consult with and advise OWNER and act as OWNER's representative as set <br /> forth herein and as provided in the ENGINEER's General Conditions and <br /> Supplementary General Conditions of the Standard Documents of the Construction <br /> Contract. <br /> <br /> 1.5.2. Make periodic visits to the site to observe the progress and quality of <br /> the executed work and to determine in general if the work is proceeding in <br /> accordance with the Contract Documents. ENGINEER will not be required to make <br /> exhaustive or continuous on-site inspections to check the quality or quantity <br /> of the work. ENGINEER will not be responsible for the construction means, <br /> methods, techniques, sequences, or procedures or the safety precautions inci- <br /> dent thereto. ENGINEER's efforts will be directed toward proviaing assurance <br /> for OWNER that the completed project will conform to the requirements of the <br /> Contract Documents, but ENGINEER will not be responsible for the Contractor's <br /> failure to perform the construction work in accordance with the Contract <br /> Documents. During such visits and on the basis of ENGINEER's on-site observa- <br /> tions as an experienced and qualified design professional, ENGINEER will keep <br /> OWNER informed of the progress of the work, will enaeavor to alert OWNER to <br /> defects and deficiencies in the work of the Contractor, and may disapprove or <br /> reject work as failing to conform to the Contract Documents. <br /> <br /> 1.5.3. Review and approve or take other appropriate action in respect of Snop <br /> Drawings, samples, ane other data which Contractor is required to submit, but <br /> only for conformance with the design concept of the PROJECT and compliance with <br /> the information given in the Contract Documents. Such reviews and approvals or <br /> other action shall not extend to means, methods, techniques, sequences, or <br /> procedures of construction or to safety precautions and programs incident <br /> thereto. <br /> <br /> 1.5.4. Act as initial interpreter of the requireunents of the Contract Docu- <br /> ments and Judge of the acceptability of the work thereunder and make decisions <br /> on all claims of OWNER and Contractor relating to the acceptability of the work <br /> or the interpretation of the requirements of the Contract Documents pertaining <br /> to the execution and progress of the work. ENGINEER shall not be liable for <br /> the results of any such interpretations or decisions rendered in good faith. <br /> <br /> 1.5.5. Based on ENGINEER's on-site observations as an experienced and <br /> qualified design professional and on ENGINEER's review of the Contractor's <br /> applications for payment and supporting data, ENGINEER will determine the <br /> amount owing to the Contractor and approve in writing payment to the Contractor <br /> in such amounts. Such approvals of pa3~nent shall constitute a representation <br /> to OWNER, based on such observations and review, that the work has progressed <br /> to the point indicated and that, to the best of ENGINEER's knowledge, <br /> <br /> -4- <br /> <br /> <br />
