<br /> THIS INSTRUMENT, made and entered into this day of August,
<br /> 1987, by and between C. F. LI~LE D~VEIDPMENT CORPORATION, RICHARD D.
<br /> SUGGS and wife SH""~Y B. SUGGS, and CABARRUS COUNTY; and
<br />
<br /> WHEREAS, C. F. Little Develo~nent Corporation is the owner of part
<br /> of lot THIRTY SIX (36), PHASE I, I~P I, c;u,~LO'r SUBDIVISON, ~p Book 21,
<br /> Page 30, Cabarrus County Registry and Rictmrd D, Suggs is the owner of
<br /> lot THIRTY FIVE (35), PHASE I, ~AP 2, CA. LOT SUBDIVISION, Map Book 21,
<br /> Page 31, Cabarrus County Registry and Richard D. Suggs is also the owner
<br /> of the remaining portion of lot ~I~IR~Y SIX (36), PHASE I, MAP I, CAMELOT
<br /> SUBDIVISION, ~ap Book 2t, Page 30; and

<br /> WHEREAS, all parties hereto have an interest in the sanitary sewer
<br />easement which is located on the common boundary between lot nu~,bers 35
<br />and 36 of Ca~mlot Subdivision, and said ~arties desire to relocate said
<br />sewer easement from its present location sho%~ on the plats of P~mse I
<br />of Camelot Subdivision recorded in ~ap Book 21, Pages 30 and 31,
<br />Cabarrus County Registry to the new location shown on ,I~hibit
<br />attached hereto;

<br /> NOW, THF~RE, for ten dollars ($10~00) and other valuable
<br />consideration, the receipt and sufficiency of which is hereby
<br />acknowledged, the parties hereby withdraw from dedication and delete the
<br />sanitary sewer ease~mnt 20 feet in %~idth located on the co.mcn boundary
<br />between lot numbers 35 and 36 as shown on the plats of P}mse I of
<br />C~unelot Subdivision, Map Book 21, Pages 30 and 31, Cabarrus County
<br />Registry. The parties hereby RELOCATE said sewer easament and DEDICATE
<br />the following strip of land 20 feet in width as a sanitary sewer
<br />easement for C~nelot Subdivision as if the following described strip of
<br />land had been originally shown on said plats of Csmelot Subdivision:

<br /> Lying and Being in N~unber One (1) Township, Cabarrus County, North
<br />Carolina, and being a strip of land 20 feet in width across part of lot
<br />n~ber 35 and part of lot n~ber 36 of P~mse I, Cmnelot Subdivision, ~l~p
<br />Book 21, Page 31 and Page 30, respectively, and being 10 feet on either
<br />side of a center line which is described more particularly as follows:

<br /> BEGINNING at a point in the northern ri~]t of way line of Somerset
<br />I~e, said point being North 53-11-54 East 160 feet from the front
<br />co~m]on corner of lot numbers 36 and 3?, Phase I, Map I, Camelot
<br />Subdivision~, Map Book 21, Page ~0, and runs thence North 35-52-~3 West
<br />200.29 feet to an iron, the rear co~mon corner of lot number 35, Phase
<br />I, ~%p 2, C~lelot Subdivision, ~p Book 21, Page 31, and lot n~.ber 36,
<br />Phase I, Map I, Cm~elot Subdivision, ~%~p Book 21, Page 30, Cabarrus
<br />County Registry, as sho~ on Exhibit "A" attached hereto and
<br />incorporated herein by reference.
