SECTION XII - PERFORMANCE BOND Each holder of a franchise shall provide and maintain a perfor- mance bond or cash deposits in amounts determined by the County Commissioners and in any event, in a minimum amount of $10,000 and on file at ~he County Manager's office of Cabarrus County, conditioned on the faithful performance of their duties here- under, which bond shall be subject to forfeiture in the event of the revocation or suspension of the franchise after the hearings provided for by Section XIII of this Ordinance or in the event of the termination of service to a franchise area by the voluntary act of the holder of the franchise. SECTION XIII - COMPETITIVE BIDDING The County Commissioners shall have the right to request bids and the payment of license fees to the County for the award of franchises upon the expiration, termination or abandonment of any franchise currently in effect or hereafter granted. Such bidding shall be upon such terms and conditions deemed by the commissioners to be in the best interest of the public health and welfare. SECTION XIV - PROCEDURES FOR SUSPENSION AND TE~4INATION Any suspension, revocation or termination of solid waste franchises or any portion thereof shall be accomplished in the following manner: A. When the Health Director shall be of the opinion that any actions or failures to act by a franchisee immediately endanger the public health and that immediate suspension of a franchise is necessary to protect the public health, the -9- 3
