Receipt of written notice by the Health Director shall be required before any franchise holder institutes afore mentioned increases. 2. The County Commissioners shall also evaluate the fee schedule on an annual basis to analyze the impact of in- creases in operating costs incurred by the haulers. Each franchise holder shall submit a completed Historical Data Comparison (Appendix B) for examination of their operating costs. SECTION XII - TIPPING FEE A. All users of landfill, except private users hauling their own personal residential garbage and rubbish, will be required to pay a tipping fee according to the schedule approved by the Board of Commissioners and listed in Appendix C. B. Landfill users will be billed monthly by the tenth day of the month following the month for which the landfill was used. Payment will be due within thirty (30) days. C. Tires will be accepted and cut at the rate approved by the Board of Commissioners and found in Appendix D. SECTION XIII - PERFORMANCE BOND Each holder of a franchise shall provide and maintain a perfor- mance bond or cash deposits in amounts determined by the County Commissioners and in any event, in a minimum amount of $10,000 and on file at the County Manager's office of Cabarrus County, conditioned on the faithful performance of their duties here- under, which bond shall be subject to forfeiture in the event of the revocation or suspension of the franchise after the hearings provided for by Section XIII of this Ordinance or in the event of the termination of service to a franchise area by the voluntary act of the holder of the franchise.
