ORDINANCE GOVERNING THE MANAGEMENT OF <br /> SOLID WASTE IN CABARRUS COUNTY, NORTH CAROLINA <br /> <br /> The Board of County Commissioners having considered the <br /> necessity of the revision and adoption of an ordinance <br /> regulating the storage, collection, transportation, use, dis- <br /> posal, management and other disposition of all forms of solid <br /> waste in Cabarrus County, North Carolina, and having found that <br /> the adoption of such an ordinance is in the best interest of <br /> the general health and welfare of the County does hereby adopt <br /> the following ordinance pursuant to the authority contained in <br /> Articles 6 of Chapter 153A of the General Statutes of North <br /> Carolina: <br /> <br /> SECTION I --DEFINITIONS <br /> <br />The following definitions shall apply through this ordinance: <br /> <br />A. "Disposal" - the discharge, deposit, injection, dumping, <br /> spilling, leaking or placing of any solid waste into or on <br /> any land so that the solid waste or any constituent part of <br /> the solid waste may enter the environment or be emitted <br /> into the air or discharged into any waters including <br /> groundwaters. <br /> <br />B. "Garbage" - all putrescible wastes, including animal offal <br /> and carcasses, and recognizable industrial by-products, but <br /> excluding sewage and human waste. <br /> <br />C. "Hazardous waste" - a solid waste, or combination of solid <br /> wastes which because of its quantity, concentration or <br /> physical chemical or infectious characteristics may: <br /> <br /> 1. Cause or significantly contribute to an increase in <br /> mortality or an increase in serious irreversible or <br /> incapacitating reversible illness; or <br /> <br /> 2. Pose a substantial present or potential hazard to <br /> human health or the environment when improperly <br /> treated, stored, transported, disposed of or other- <br /> wise managed. <br /> <br />D. "Hazardous waste generation" - the act or process of pro- <br /> ducing hazardous waste. <br /> <br />E. "Hazardous waste management" - the systematic control of <br /> the collection, source separation, storage, transportation, <br /> processing, treatment, recovery and disposal of hazardous <br /> wastes. <br /> <br /> <br />
