ORDINANCE GOVERNING THE MANAGEMENT OF SOLID WASTE IN CABARRUS COUNTY, NORTH CAROLINA The Board of County Commissioners having considered the necessity of the revision and adoption of an ordinance regulating the storage, collection, transportation, use, dis- posal, management and other disposition of all forms of solid waste in Cabarrus County, North Carolina, and having found that the adoption of such an ordinance is in the best interest of the general health and welfare of the County does hereby adopt the following ordinance pursuant to the authority contained in Articles 6 of Chapter 153A of the General Statutes of North Carolina: SECTION I --DEFINITIONS The following definitions shall apply through this ordinance: A. "Disposal" - the discharge, deposit, injection, dumping, spilling, leaking or placing of any solid waste into or on any land so that the solid waste or any constituent part of the solid waste may enter the environment or be emitted into the air or discharged into any waters including groundwaters. B. "Garbage" - all putrescible wastes, including animal offal and carcasses, and recognizable industrial by-products, but excluding sewage and human waste. C. "Hazardous waste" - a solid waste, or combination of solid wastes which because of its quantity, concentration or physical chemical or infectious characteristics may: 1. Cause or significantly contribute to an increase in mortality or an increase in serious irreversible or incapacitating reversible illness; or 2. Pose a substantial present or potential hazard to human health or the environment when improperly treated, stored, transported, disposed of or other- wise managed. D. "Hazardous waste generation" - the act or process of pro- ducing hazardous waste. E. "Hazardous waste management" - the systematic control of the collection, source separation, storage, transportation, processing, treatment, recovery and disposal of hazardous wastes.
