I

**~?,?;,... CABARRUS COUNTY "' f~F~ ~-;~ ":'

February 25, leS&

Commissioner Archie Bernhardt
Fire Commissioner
409 Winecoff School Rd.
Concord, NC 28025

Dear Mr. Bernhardt:

As you requested we reviewed the changes in the Caberrus
County Fire Protection Resolution proposed by several fire
departments.
I see no problem with most of the proposed changes, however,
some of the wording and references in the changes are vague. My
comments are as follows: .....

Section 3
On replacing "herein specified" with "set by state f re
protection law":

Minimum standards for fire departments are not genera y set
forth in state law. The only reference to the equipment required
for a tire department is in GS lis where it states to participate
in the Fireman's Pension Fund the department must have equipment
worth $5,000.

Insurance Services Otfice (lSD) has requirements for fire
departments in order for their communities to qualify for a
reduction in insurance premiums.

The NC Department o! Insurance has requirements for the
tnt.rial certification of fire departments wishing to participate
in the Fireman's Relief Fund. These are the requirements we have
specified in section 5 (d) of the resolution however they are not
in state law.

in regard to training, the resolution requires only what the
state law sets forth.

On removing "but the Fire Marshal may make other such
inspections as deemed necessary":

This was only placed here as a safeguard ip case of changes
during the year. I foresee no problem with its removal el long
es the departments do not change dreatically during the b~dgst
year. ~,~
