NOW, T~ERF~ORE, in consideration of the premises contained herein, the parties hereby agree as follows: 1. The District will prepare all necessary plans, specifica- tions, contract documents, and permit applications necessaz~ to construct said project. 2. The .total project cost will be determined by the district soliciting a minimum of three competitive bids. 3. The Applicant agrees to pay the cost of all facilities up to and including 6 inches in size and any special facilities required by the applicant. 4. The District agrees to pay the cost for all facilities larger than 6 inches or any special facilities that the District may require.. 5. The Applicants portion of the project cost shall be determined based on the bid unit price for material less the Districts normal purchase price for comparable quality material of 6 inch size material plus the bid unit price per labor less the following percentages based on size of facilities: 8" - 3%, 12" - 16" - 12%. 6. The Applicant will deposit to the District the required amount within 10 days after notification. Failure to make the deposit within the 10 days will negate this contract. 8. The contract will be awarded to the certified low bidder after all funds haYe been deposited with the district. 9. The cost for any additional unforseen work encountered during the project shall be shared under the same formula described in item 5 above. The Applicant agrees to deposit any additional funds within 30 days after the completion of the project. 10. The District shall own all facilities installed under this contract and shall collect all fees for service rendered and al! lateral connections made from said facilities, at the usual rates charged for such service, and all such collection shall be retained by the district as compensation for the maintenance and operation of said system.
