K?nnapolis Sanitary l)istrie!

KANNAPOLI$, NORTH CAROLINA

July 21, 1986

Mr. James Lentz, Chairman
cabarrus County Board of Commissioners
Cabarrus County Courthouse
Concord, North Carolina 28025

Dear Mr. Lentz:

Mr. Phillip M. Meacham and Mr. Melvin W. Rape, members of the
Board of Commissioners for the Kannapolis Sanitary District,
have submitted their resignations as Board members, and these
resignations have been accepted by the Kannapolis Sanitary
District Board. The Kannapolis Sanitary District Board had
delayed in requesting that these vacancies be filled because
of the pending merger election. But since the merger was not
approved, we feel it is in the best interest of the Kannapolis
Sanitary District that the two vacancies be filled.

North Carolina General Statutes, Chapter 130A, Section 54,
provides: "If the district is located in more than one county,
the vacancy shall be filled by the County Commissioners of the
County from which the vacancy occurred." Mr. Meacham and Mr.
Rape were both residents of Cabarrus County. Therefore, the
Cabarrus County Board of Commissioners is the proper board to
fill the vacancies.

The Kannapolis Sanitary District Board, after very careful
consideration, would like to recommend to you the following
two persons to fill these vacancies:

Mr. ~~.~.ip~_, 601 Jackson Street, Kannapolis, North
CaroIfna, to fill ~he unexpired term of Mr. Phillip M. Meacham.

~...-Mr. ~_~_i~, 308 Melinda Avenue, Kannapolis, North
Car~fi~,~-f-d--fill the unexpired term of Mr. Melvin Wo ~ape.

This recommendation was approved unanimously by the present
members of the Kannapolis Sanitary District Board.

Sincerely,

Everette L.
