2. ObllBations of the Recipient. The recipient shall perform the program as specified in the application approved by NRCD. The recipient shall comply vith the certifications pursuant to Paragraph (f) of Rule .O&01 of the North Carolina Community Development Block Grant Administra- tive Rules, 15 NCAC 13L .0407(f). The recipient shall also comply vith all other la~ful requirements of NRCD, all applicable requirements of the General Statutes of the State of North Carolina and any othsr appli- cable lava and £xecutive Orders currently or hereafter in force. 3. ObliBations of Recipient with Respect to Certain Third Party Relationships. NRCD shall hold the recipient responsible for complying vith the provisions of this agreement even vhen the recipient designates a third party or parties to undertake all or any part of the program. The recipient shall comply vith all lavful requirements of ~tRCD necessary to insure that the prosram is carried out in accordance vith the recipient% certifications including the certification of assumption of environmental responsibilities under Rule .1001 of the North Carolina Community Develop- ment Block Grant Administrative Rules, 15 NCAC 13L .1004. 4. Interest of Hembers, Officers, or Employees of the Recipient, Hembers of Local Covernin~ Body, or Other Public Officials. No member~ officer, or employee of the recipient, or its agents, no member of the governing body of the locality in which the program is situated, and ua other public official of such locality or localities vho exercises any functions or responsibilities ~ith respect to the program during his tenure or for one year thereafter, shall have any financial interest, either direct or indirect, in any contract or subcontract, or the proceeds thereof, for york to be performed in connection ~lth the program assisted under this agreement. Immediate family members of said members, officers, employees, and officials are similarly barred from having an}' financial interest in the program. The recipient shall incorporate, or cause to be incorporated, in all such contracts or subcontracts, a provision prohibiting such interest pursuant to the purpose of this section. The assistance provided under this agreement shall not be used in the payment of any bonus or commission for the purpose of obtaining NRCD approval of the application for such assistance, or NRCD approval of applications for additional assistance, or any other approval or concurrence of NRCD required under this agreement, or the North Carolina Community Development Block Grant Administrative Rules, with respect thereto; provided, houever, that reasonable fees or bona fide technical, consultant. managerial or other such services, other than actual solicitation, are not hereby prohibited if other~ise eligible as program costs. 5. Reimbursement to NRCD for Improper Expenditures: The recipient u111 reimburse NRCD for any amount of grant assistance improperly expended.
