NOW, ..~.E~FORE, in consideration of the premises con':dined hare/n, the parties hereby agree as fol'lows: 1. The Applicant is hereby granted ~ermission to connect only those certain sanitary sewer lines as hereinbefore described, at the certain location or locations as previously ~escribed herein. The permission so gr~nted shall not be construed as granting permission for any additions or extensions desired to be constructed by the Applicant or others; such additions or extensions shall require a separate and new agreement between the County and the parties desiring to make such additions or extensions. 2. All construction pertaining to sanitary sewerage shall be performed by a licensed Utility Contractor. The Applicant agrees to furnish the Cabarrus County Utility Department with the name and license number as listed with the North Carolina Licensing Board, of %he Contractor whm has be,n retained to construct %he before-described sewerage system. 3. The Applicant agrees to construct the sanitary sewer lines, including any appurtenant structures and equipment, according to the Plans and Profiles as approved by the Count~ Engineer and in strict accordance with the cur- rent specifications and design criteria of the Cabarrus County Utility Department. The applicant also agrees to furnish prior written notice to the County Engineer as to the exact date construction will begin, and further agrees to furnish the County Engineer every reasonable facility to ascertain whether or not the wo£k as perfo~ned is in accordance with the specifications. It is understood and agreed that Inspectors employed by the County shall be stationed at the work to report as to the progress and performance of the work, and shall be authorized to inspect any part of the work done and any material furnished, including its preparation or manufacture. No sewer pipe or other appurtenance shall be placed except in the presence of the County Engineer or his authorized Inspectors without special permission of the Utility Director. Such Inspectors, however, shall not relieve the Applicant from any obligation to perform all of the work strictly in accord~ce with the Specifications. In case of any disputes arising as to the materials furnished or the manner of performing the work, the County Engineer shall have authority to reject materials or suspend work until the question at issue can be referred to and decided by %he Utility Director. It is further understoo~ and agreed that the Appli- cant shall remove any work or materials condemned as unsatisfactory by the CouBty Engineer and shall rebuild and replace same to the standard required by the specifications, all at his own expense and in default thereof, the same may be done by the County and the cost charged against the Applicant. Final connection to the County's sanitary sewerage system will not be per- mitted untll all work has been approved by the County Engineer.
