NORTH CAROLINA <br /> GR~RT OF ~ASEMENT <br /> CABARRUS COUNTY <br /> <br /> THIS AGREEMENT, made and entered into this -- day of May, <br />1905, by and between the COUNTY OF ROWAN, the COUNTY OF CABARRUS, and <br />CANNON MILLS COMPANY (hereinafter referred to as the "COUNTIES"), and <br />the KANNAPOLIS SANITARY DISTRICT (hereinafter referred to as the <br />"SANITARY DISTRICT"), <br /> <br /> WI~ESSETH: that <br /> <br /> FOR AND IN CONSIDERATION of the sum of One Dollar ($1.00) and <br />other valuable considerations, the receipt whereof is hereby acknowl- <br />edged, CGONTIEE have bargained and sold and by these presents, do <br />hereby grant, bargain, sell and convey unto SANITARY DISTRICT a <br />permanent easement and right-of-way, includinq the perpetual right <br />to enter upon the real estate hereinafter described, at any time that <br />it may see fit, and construct, operate, maintain and repair manholes, <br />sewage meter chambers, gate valves and boxes, fire hydrants, meters, <br />pumps, and any and all other devices necessary or useful in the <br />operation of a public water and sewer system, including underground <br />pipe lines and/or mains for the purpose of conveying water and/or <br />sewer over, across, through and under the lands hereinafter described, <br />together with the right to excavate and refill ditches and/or trenches <br />for the location of said pipe lines and/or mains, and the further <br />right to remove trees, bushes, undergrowth, and other obstructions <br />interfering with the location, construction and ~intenance of said <br />pipe lines and/or mains upon the property of the COUNTIES described <br />as follows: <br /> <br /> BEGINNING at a point in the right-of-way of Glenn Avenue <br /> (said point being South 00-28-37 East 11.11 feet from <br /> existing manhole 5 at station 16 plus 33.00), and runs <br /> thence a center line, more or less, with Glenn Avenue <br /> (SR 1113) South 00-28-37 West 276.89 feet, more or less, to <br /> ~nhole 4 at station 13 plus 4S.00; thence South 65-46-31 <br /> West 440.00 feet to ~anhole 3 at station 9 plus 05.00; thence <br /> South 15-$3-01 West 355.00 feet to manhole 2 at station S <br /> plus 50.00; thence South 12-30-26 West, 287.16 feet to man- <br /> hole I at station 2 plus 62.84; thence generally with the <br /> existing easement for a 30-inch water line, South 28-04-26 <br /> East 236.94 feet to a point in the line of Baker's Creek <br /> Park and Cannon Holding Corporation, said point being <br /> North 20-04-26 West 25.90 feet from an existing manhole at <br /> station 0 plus 00.00 in an existing sanitary sewer right-of- <br /> way in the property of Cannon Holding Corporation, all of the <br /> foregoing being ~re particularly described in a physical <br /> survey dated January 10, 1985, by Concord Engineerin9 and <br /> Surveying, Inc., entitled Big Elm - Baker's Creek Sanitary <br /> <br /> This right-of-way shall extend 20 feet On each side of the <br /> abuve-described center line during the period of construction <br /> and thereafter shall extend 15 feet on each side of said <br /> <br /> Cannon Mills Company joins in ~he execution of this right-of-way <br />for the sole purpose of granting permission of the use by the Kanna- <br />pelis Sanitary District of the right-of-way which Cannon Mills Company <br />holds along the above-described easement. <br /> <br /> <br />
