Management Agreement between the Cabarrus-Rowan Park Commission and the Cabarrus <br />County Local Government <br /> <br /> WITNESSETH <br /> <br /> WHEREAS, the Cabarrus-Rowan Park Commission, herein referred to as "the <br />Commission," desires to provide park facilities and recreation services in the <br />Northern Cabarrus and Southern Rowan area of Cabarrus and Rowan Counties, and <br /> <br /> WHEREAS, the local government of Cabarrus County, herein referred to as <br />"the County," is willing to provide management services to the degree as outlined <br />in this agreement, <br /> <br /> Now therefore, the two entities agree to the following: <br /> <br /> The Commission agrees to:' <br /> <br /> 1. Designate the County Manager as the Commission's Purchasing Agent for <br /> all purchases by the Park Commission. <br /> <br /> 2. By February I of each year, prepare and submit an operations, maintenance, <br /> and capital construction budget to the respective recreation commissions <br /> of all participating units. <br /> <br /> 3. Follow in strict accordance all North Carolina State Statutes that relate <br /> to the bidding of supplies, the awarding of construction projects, and <br /> other duties the Board is empowered to perform. <br /> <br /> 4. Save harmless and indemnify ~he County against all claims, losses, <br /> damages, injuries, causes of action, lawsuits, expenses, and liability <br /> arising from or arising out of the Commission's failure to comply with <br /> the responsibilities and stipulations found herein and other responsibilities <br /> as outlined in the "Resolution creating the Joint Park Commission," <br /> wherever such claims, losses, damages, injuries, causes of action, lawsuits, <br /> expenses and liabilities arise from the negligent or willful acts or <br /> omissions of the Commission. <br /> <br /> The County agrees: <br /> <br /> 1. To provide accounting and other fiscal control in compliance with <br /> accounting procedures stipulated in North Carolina General Statutes 159. <br /> <br /> 2. To invoice all participating units of the Commission on a monthly basis <br /> based on the participating unit's proportionate share of the financial <br /> obligation of the Commission for the previous month. <br /> <br /> 3. To provide monthly financial reports on all the Co~ission's expenditures <br /> and revenue receipts for the previous month and a summary of the year-to- <br /> date expenditures and revenue collections of the Commission. <br /> <br /> 4. To provide an annual audit of the Commission's budget and expenditures as <br /> required by the North Carolina Local Government Commission. <br /> <br /> <br />
