O, Box 707 Concord~ North Carolina 2g025 Re: Paving .25 Mile of Cessna Road (SR I~Q3) Dear Chairman Lentz: I have reviewed your letter of 3anuary 9~ 198# with Secondary Roads Officer 3ack Murdock and regretfully must in{orm you that you have not yet met the requirements which are necessary for us to pursue the paving of this road. As I indicated in my previous letter and per procedure, the Cabarrus County Corrmissioners will need to place a legal advertisement in the local paper of general circulation in Cabarrus County indicating "that a Public Hearing is to be held on a (specific date) for the purpose of determining if the County Commissioners should request the Department of Transportation to pave .25 of a mile of Cessna Road (SR lhq3)". This would need to be placed in the paper at least two times over a period of two weeks prior to having the Public Hearing. ^fret this requirement has been met you would then inform me of the Corrmissioner's vote and if the vote were in favor of ~ this p~e.~c~ of ~oad oot of oriorltv. The Board of ransportat~On could then consider your request. I cannot speak for Board Member Frank McCray but it is my opinion that he would support the County Corrmissioners in any reasonable request. 1 am sure that Board Member McCray would be more than willing to be present at that Public Hearing as well as repre- sentatives from this office. I personally think that what you desire to do in this matter is reasonable and I would support your endeavors. However, we must be in compliance with the procedure in this matter.
