NORTH CAROLINA RIGHT OF WAY AGREEMENT CABARRUS COUNTY THIS RIGHT OF WAY AGREEMENT, made and entered Into this 16th day of March, 198~, by and between CABARRUS COUNTY, · governmental subdivision of the State of North Carolina, party of the first part; and THE HOARD OF LIGHT AND WATER COMMISSIONERS OF THE CITY OF CONCORD, a governmental subdivision of the State of North Carolina, party of the second pert; WlTNESSETH:- That for and in consideration of the sum of One Dollar ($1.00) and other valuable considerations to the Said party of the first part in hand paid, the receipt of which is hereby acknowledged, the party of the first part does hereby give, grant and convey unto the party of the second part, its succes- sors and assigns, a Utility easement for the construction, installation and maintenance of an electric utility line across the property hereinafter describ~ Mid easement to be ten feet ~/Ide and nmre particularly describe~ as follows: Lying and being in No. 12 Township, Cabarrus County, North Carolina, on the South side of Means Avenue, Southeast, and more partlcularl described as follows: BEGINNING at a new iron stake In the South edge of Means Avenue~ Southeast (said stake being S~ 116-19-06 W. 33~25 feet from an existing iron pin the northeast corner of a lot leased to Historic Cabarrus, Inc., by the party of the first part); and runs thence S~ 61-38-59 E. 17.73 feet to nn Iron pin; thence S. ~11~38-59E. 111.29 feet to an iron pin; thence S~ 86-38-59 E. 38.q2 feet to an iron pi~ in th East line of the property leased to Historic Cabarrus, Inc.; thence wlth the East line of said leased property~ S. ~1-3B-59 E. 7.13 fee to an existing iron pin, the Southeast corner of the tract leased to Historic Cabarrus, Inc,; theslce with the South line of said leased tract, S. ~18-15-06 W. 7 feet to an iron pin; thence N. 86-38-59 W. #2.65 feet to an iron pin; thence N. ql-38-59 W. ~13.67 feet to an iron pin; thence N. 61-38-59 W. 19.21 feet to an iron pin in the South edge of Means Avenue; thence with the South edge of Means Avenue, N. ~15-19-05 E. 10.51 feet to the BEGINNING. TO HAVE AND TO HOLD the aforesaid easement unto the said party of the second part, its successors and assigns, forever.
