NORTH CAROLINA <br /> <br />CABARRUS COUNTY <br /> <br /> THIS LEASE AGREEMENT, made and entered into this 16th day of <br />May, 19B3, by and between CABARRUS COUNTY, party of the first part (here- <br />inafter referred to as "CABARRUS"), and BOARD OF LIGHT AND WATER <br />COMMISSIONERS OF THE CITY OF CONCORD, party of the second part (here- <br />inafter referred to as "BOARD"); <br /> <br /> WITNESSETH :- <br /> <br /> That whereas, Cabarrus through grants from the State and Federal <br />Government, has constructed a sewer collection system in the area of Cabarrus <br />County off of Ce?tral Drive known as Sidestown-Shankletown area, which <br />sewage collection system c6nnects witi~ tile interceptor sewer lines presently <br />being operated by the Board; and whereas Cabarrus and the Board have agreed <br />that for the best interest of both parties that the sewer collections system, <br />hereinafter and above referred to, should be operated and maintained by the <br />Board, and that the Board will accept said system, and said system be leased <br />to the Board by Cabarrus. <br /> <br /> NOW, THEREFORE, in consideration of the premises and the agree- <br />ments hereinafter made, Cabarrus does hereby let and lease to the Board the <br />perpetural right of way for a sewer line and the sewer line which has been <br />constructed on said right of way in the Sidestown-Shankletown area of <br /> <br />Cabarrus County, said rights of way having been granted to Cabarrus. <br /> <br /> The terms and conditions of this Lease are as follows: <br /> <br /> I. The Board hereby agrees to maintain said sewer collection <br />system and to accept sewage from the persons and businesses connected to said <br />sewer collection system for treatment at its treatment facility, and to collect the <br />cost of said treatment from the persons in businesses using said sewag~ <br />collection system. It is furthe,.r agreed that the cost of treatment shall be <br />determined from time-to-time by the Board, or its successors, said cost to be <br />not more than the cost charged similar type customers located outside of the <br />corporate limits of ~he City of Concord. which charge shall be paid by the <br />~ersons using the system. <br /> <br /> <br />
