ORDINANCE GOVERNING SuRFA~cE~.I.._SCHARGE SEWAGE TREATMENT PLANTS IN CABARRUS COUNTY, NORTH CAROLINA The Board of Commissioners, having considered the necessity of an ordinance regulating the discharge of wastewater into surface waters of Cabarrus County~ North Carolina, and-having found that the adoption of such an ordinance is ia the best interest of the general health and welfare of the County does hereby adopt the folowing ordinance pursuant to the authprity contained in Chapter 130 and Chapter 130(A) of the North Carolina General Statutes. Section I - General Conditions: A. No person shall commence the construction or relocation of any residence, place of business, or place of public assembly, nor shall any person locate, relocate or cause to be ocated or fo be relocated any residence other than one exhibited for sale or stored for the purpose of later sale on a site 'n an area not served by a public system of sewage treatment without first obtaining a discharge permit and aa authorization permit from the North Carolina Department of Natural Resources and Community Development (NRCD) or an improvements permit from the Cabarrus County Health Department. Copies of discharge authorization permits shall be filed with the health department prior to the issuance of a building permit and shall include the location of the surface discharge system and the exact location of the point of wastewater discharge. B. The effluent of all package treatment plants and single-family surface discharge systems shall be monitored by the Cabarrus County Health Department for environmental impact on surface waters al a minimum of once per year. Systems out of compliance with eff went limitations established with the North Carolina Admini. strative Code shall be reported to the North Carolina Department of Natural Resources ant Community Development for enforcement action. In addition, these systems shall be monitored by the Cabarrus County Health Department at least twice within a six month period after the deadline imposed for compliance by the Depart- ment of Natural Resources and Community Development to assure that compliance has been obtained, ifp at either of these two monitoring inspections, the system is found t6 be out of compliance with the applicable requirements cited above, then the pa.rty in violation thereof shall be punished as provided in General Statutes 130(A)-25. C. A violation of this ordinance shal subject the part in violation to punishment as provided in G. S. 130(A) of the Genera Statutes of North Carolina.
