GENERAL ASSEMBLY OF NORTH CAROLINA <br /> SESSION 198i <br /> RATIFIED BILL <br /> <br /> CHAPTER 923 <br /> <br /> HOUSE BILL' 1098 <br /> <br /> AN ACT TO CREATE A DOMICILIARY HOME RESIDENTS' RiLL OF RIGHTS. <br /> The General Assembly of North Carolina enacts: <br /> <br /> Sec%ion ]. Chapter ~31C of the GeLeral Statutes~ as <br /> <br /> enacted by Section 2 of Chapter 275, Session Laws of 1981~ is <br /> <br /> amended by adding the following new A;~ticle: <br /> "ARTICLE 4. <br /> ,'Domiciliary Home Residents. Sill of Rights. <br /> <br /> "§ 131C-50. ~j. slative intent.--It is the intent of the <br />General Assembly to promote the interests and well-being of the <br />residents in domiciliary homes to include Family Care Homes, <br />Homes for the Aued and 'Disabled, and Group Homes for <br />DeveLopmentally Disabled Adults licensed pursuant to G.S. ]08-77. <br />It is the intent of the General Assembly that every resident's <br />civil and religions liberties, including the right to independent <br />personal.decisions and knowledge of available choices, shall not <br />be infringed and that the facilit~ shal~ encourage and assist the <br />resident i~ the fuligst possible exercise of ~hese rights. <br /> <br /> "§. ~31C-5~. Definitions.--As used in this Article, the <br /> <br /> foliowin§ terms have the meanings specified: <br /> {li 'Abuse' has the same meaning as in G.S. 108A-152(a). <br /> <br /> (2) 'Domiciliary Home' means any facility, by whatever name it <br />is called, which provides residenfial care for aged or disabled <br />persons whos~ principal n~ed J.s a home with the si~eltered or <br /> <br /> <br />
