RESOLUTION CLOSI~G TWO PORTIONS OF A SIXTY (60) FOOT ROAD SHOWN ON PLAT RECORDED IN PLAT BOOK 15, PAGE 41~ CABARRUS COUNTY PUBLIC REGISTRY, OFF TOM QUERY ROAD WHEREAS, a Petition has been filed and received in accordance with the provisions of Chapter 153A, Section 241, of the General Statutes of North Carotina, requesting the closing of two certain portions of the sixty (60) foot road shown on plat recorded in Plat Book !5, Page 41, Cabarrus County Public Registry; WHEREAS, the Board of Commissioners has caused to be published a Notice of Public Hearing, all in accordance with said Statute; WHEREAS, the public hearing was held on the day of , 1983; WHEREAS, DMS MAY COMPANY owns the land adjoining the two portions of the road; WHEREAS, no persons, firms or corporations or parties in interest have appeared in opposition to the closing of the two portions of the road; THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the County of Cabarrus, North Carolina: That the Board of Commissioners hereby orders the closing of those two certain portions of that certain sixty (60) foot road shown on plat recorded in Pt~t Book 15, Page 41, Cabarrus County Public Registry, ("the road"), which two portions of the road are shown on a survey prepared by Concord Engineering & Surveying, Inc., dated May 15, 1982, a copy of which shall be duly recorded in the Cabarrus County Public Registry and which is made a part hereof by reference thereto, and which two portions of the road are more particularly described in Addendum A attached hereto and made a part hereof, and it appearing to the satisfaction of the Board of Commissioners that the closing of those two portions of the road is not contrary to the public interest and that no individual, firm or corporation owning property in the vicinity thereof will be deprived of reasonable means of ingress and egress to his or its property.
