RESOLUTION CLOSI~G TWO PORTIONS <br /> OF A SIXTY (60) FOOT ROAD SHOWN <br /> ON PLAT RECORDED IN PLAT BOOK 15, <br /> PAGE 41~ CABARRUS COUNTY PUBLIC <br /> REGISTRY, OFF TOM QUERY ROAD <br /> <br /> WHEREAS, a Petition has been filed and received in <br />accordance with the provisions of Chapter 153A, Section 241, of <br />the General Statutes of North Carotina, requesting the closing of <br />two certain portions of the sixty (60) foot road shown on plat <br />recorded in Plat Book !5, Page 41, Cabarrus County Public <br />Registry; <br /> <br /> WHEREAS, the Board of Commissioners has caused to be <br />published a Notice of Public Hearing, all in accordance with said <br />Statute; <br /> <br /> WHEREAS, the public hearing was held on the day of , 1983; <br /> <br /> WHEREAS, DMS MAY COMPANY owns the land adjoining the <br />two portions of the road; <br /> <br /> WHEREAS, no persons, firms or corporations or parties in <br />interest have appeared in opposition to the closing of the two <br />portions of the road; <br /> <br /> THEREFORE, BE IT RESOLVED, by the Board of Commissioners of <br />the County of Cabarrus, North Carolina: <br /> <br /> That the Board of Commissioners hereby orders the <br /> closing of those two certain portions of that certain <br /> sixty (60) foot road shown on plat recorded in Pt~t <br /> Book 15, Page 41, Cabarrus County Public Registry, <br /> ("the road"), which two portions of the road are <br /> shown on a survey prepared by Concord Engineering & <br /> Surveying, Inc., dated May 15, 1982, a copy of which shall <br /> be duly recorded in the Cabarrus County Public Registry and <br /> which is made a part hereof by reference thereto, and which <br /> two portions of the road are more particularly described in <br /> Addendum A attached hereto and made a part hereof, and it <br /> appearing to the satisfaction of the Board of Commissioners <br /> that the closing of those two portions of the road is not <br /> contrary to the public interest and that no individual, <br /> firm or corporation owning property in the vicinity thereof <br /> will be deprived of reasonable means of ingress and egress <br /> to his or its property. <br /> <br /> <br />
