Al; ORDINANCE ESTABLISHING MINIbFOM HOUSING STANDARDS <br /> FOR CABARRUS COUNTY, NORTH CAROLINA <br /> <br />BE IT ORDAINED BY THE BOARD OF COb%~TY COi~.[ISS!ONERS OF CABARRUS <br />COUNTY: <br /> <br /> Section I. Finding; Purpose. Pursuant to G.S. 160A-441, it is <br />hereby declared than there exist in Cabarrus County dwellings which <br />are unfit for hmman habitation due to dilapidation: defects increasing <br />[he hazards of fire, accidents and other calamities: lack of venni!a- <br />tion, light and sanitary facilities: and other conditions rendering <br />such dwellings unsafe or unsanitary, dangerous, and detrimental to <br />the health, safety and morals, and otherwise inimical to the welfare <br />of the residents of Cabarrus County. <br /> <br /> In order to protect the health, safety and welfare of the residents <br />of Cabarrus County as authorized by part of Article 19, Chapter 160A <br />of the General Statutes, it is the purpose of this ordinance to <br />establish minim~um standards of fitness for the initial and continued <br />occupancy of all buildings used for human habitation, as expressly <br />authorized by G.S. 160A-444. <br /> <br /> Section II. Definitions. The following definitions shall apply <br />in the interpretation an--~--~n-forcement of this ordinance: <br /> <br /> (1) Basement shall mean a portion of a dwelling which is located <br /> ~nderground, having direct access to light and <br /> air from windows located above the level of the adjoining <br /> ground. <br /> <br /> (2) Cellar shall mean a portion of a dwelling which is located <br /> partly or wholly underground having an inadequate access <br /> to light and air from windows located partly or wholly <br /> below of the adjoining ground. <br /> <br /> (3) Deteriorated shall mean that a dwelling may be unfit for <br /> h~man ha6-i~ion and can be repaired, altered, or improved <br /> to comply with all of the minimum standards established <br /> by this ordinance at a cost not in excess of fifty percent <br /> (50%) of its value, as determined by finding of the Housing <br /> Inspector. <br /> <br /> (4) Di!a~idated shall mean that a dwelling is unfit for htm~an <br /> habitation and cannot be improved, repaired, or altered to <br /> comply with ail of the minimmm standards established by <br /> this ordinance except at a cost in excess of fifty percent <br /> (50%) of its value: as determined by the Housing inspector. <br /> <br /> (5) ~welling shall mean any building, structure, or part there- <br /> of which is wholly or partly used or intended, to be used <br /> for living, sleeping or habitation by h~nan occupants, and <br /> includes any outhouses and apphrtenances belonging thereto <br /> or usually enjoyed therewith.
