Section VT~_ ·. Procedure for Enforcement. (a) Pre_l~ _!nvesti~n; Notice; Hearing. ~.~enever a petition is filed with the Inspector by a Public Authority or by at least five (5) residents of Cabarrus County, at least eighteen (18) years of age, charging that any dwelling or dwelling unit is unfit for human habitation, or whenever it appears to the Inspector, upon inspection, that any dwelling or d.:e ~-,s unit is unfit for human habitation hesha~.~,~ :=~ '~'~,~ p~e-~.. liminary investigation discloses a basis for such charges, issue and cause to be served ~:pon the o%,~ner of and parties in interest in such dwelling or dwelling unit a complRint Stating the charges and containing a notice that a hearing will be held before the Inspector at a place therein fixed, not less than ten (!0) nor more than thirty (30) days after the serving of said complaint. The o~ner or any part), in interest shall have the right to correct the violation or to file an answer to the complaint and to appear in person, or send a. representative, and give testimony at the place and time fixed in the complaint. Notice of such hear- ing shall be given to at least one (1) of the persons signing a petiti, on relating to such dwelling, a.ny person desiring to do so may attend such hearing and give evidence relevant to the matter being heard. The rules of evidence prevailing in courts of law or equity shall not be controlling in hearings before the Inspector. (b) Procedure After Hearing. After such notice and hearing, the Inspector shall state in writing his determination whether the dwelling or dwetling unit is unfit for human habithtion and, if so, whether it is deteriorated or di- lapidated. If the Inspector determines that the dwelling or dwelling unit is deteriorated, he shall state in writing his find- ings of fact in support of such determination, and shall issue and cause to be served upon the owner thereof an order directing and requiring the o~-a~er to repair, alter, or improve such dwelling or dwelling unit to comply with the minimum standards of fitness established by this ordinance within ninety (90) days. Such order may also direct and require the o~rner to vacate and close such dwelling or dwelling unit until such repairs, alterations, and improvements have been made. If the inspector determines that the dwelling is di!api_- dated, he shall state in writing his finding of fact to support such determination, and shall issue and cause to be served upon the owner thereof an order directing and requiring the owner either to repair, alter or im- prove such dwelling or dwelling unit to comply with the minimum standards of fitness established by this ordi- nance, or else to vacate and demolish and remove same
