this ordinance, and the enforcement of an5, remedy provided herein shall not prevent the enforcement of any other remedy or remedies provided herein or in other ordinances or laws. Section XV!V. Zoning Board of Adjustment to Hear Appeals. All appeals which may be taken from decisions or o~-~ders. of the inspector pursuant to Section XIV (d) of ~-his ordinance shall be heard and determined by the Zoning Board of Adjust- ment. As the appeals body, the Board shall have the power to fix the times and places of its meetings, to adop[ necessary rules of procedure and any other rules and regulations which may be necessary for the proper discharge of its duties. The Board shall perform the duties prescribed by Section XIV (d) and shall keep an accurate record of ali ins proceedings. The Board shall consist of five (5) members to serw-~ for three (3) year staggered terms who shall be appointed by the Board of County Commissioners. No member shall serve more than two (2) full consecutive terms. Any member who fails to attend at least seventy-five percent (75%) of the regular and special meetings and hearings held by the Board during any one (!) year period shall be automatically removed from said Board. Vacancies resulting from a member's failure to attend the re- quired number of meetings and hearings shall be filled by the same method as provided for appointments. Section XX. Conflict With Other Provisions. In the event any 'provision, standard, or requirement of this ordinance is found to be in conflict with any provision of any other ordinance or code of Cabarrus County, the provision which establishes the higher standard or more stringent re- quirement for the promotion and protection of the health and safety of the residents of Cabarrus County shall prevail. Section XXI. Violations; Penalty. (a) It shall be unlawful for the owner of any dwelling or d,~el~_~ng unit to fail, neglect, or refuse to repair, alter, or improve gbe same, or to vacate and close and remove or demolish sad re~ove the same, upon order of the Inspector duly made and served ss herein provided, within the time specified in such order. Each day that any such failure, neglect, or refusal ~o comply with such order continues shall constitute a separate and distinct offense. (b) It shall be unlawful for the owner of an), dwelling or dwelling unit, with respect to which an order has been issued pursuant to Section XIV of this Ordinance, to occupy or pe~nnit the occupancy of the same after the time prescribed in such order for its repair, alteration or improvement or its vacation and closing. Each day that such occupancy continues after st:ch prescribed ti~ne shall constitute a separate and distinct offense. -17-
