~QUEST FOR BiDS ON EXCAVATION OF ONE (1) GAP~AGE HO~ AT SANITARY I~NDF!LL Sealed bids, subject to the conditions attached hereto and as described in advertisement date March 25, 1982, will be received until 10:00 a.m. April 2, 1982, at Cabarrus County Court House, Concord~ North Carolina, and then publicly opened for completing the excavation described in the attached list. By: Board of County Commissioners Ralph Bonds, Chairman Charles D. McGinnis, County Manager CONDITIONS 1. The Board of County Commissioners reserves the right to reject any and all bids and to waive any informality in bids. 2. Bids for the excavation will be accepted on a lump sum basis according to bid specifications and requirements. 3. The bidder must submit a bid guarantee of 5% cash or certified check drawn on some bank or trust company licensed by the Federal Deposit Insurance Corporation. In lieu of making the cash deposit as above provided, the bidder may file a 5% bid bond executed b~ a corporate surety licensed under the laws of North Carolina to execute such bonds conditioned' that the surety will upon demand forthwith make payment to the obligee upon said bond if the bidder fails to execute the contract in accordance with the bid bond and upon failure to forthwith make payment the surety shall pay to the obligee an amount equal to double the a~ount of said bid bond. This deposit shall be retained if the successful bidder fails to execute the contract within ten days after the award of fails to give satisfactory surety as required herein. 4. In case of default of the contractor, the health department may procure the service from other sources and hold the contractor and/or his surety for any excess cost derived therefrom. 5. The bidder awarded the contract shall post a performance bond guaranteeing the excavation to be completed in 30 working days according to the bid specifications and requirements. 6. All bids must be firm. Bids containing rock clauses must stipulate the exact cost of rock removal if it is in addition to the bid.
