Officers of the North Carolina County Attorneys Association will meet
with Mr. Wade on Wednesday, December 16, to review the trial court
decision and consider the prospects on appeal. The meeting is scheduled
for 12:30 - 2:30 p.m. at the Albert Coates Local Government Center.

Within s few days, we will provide you with an updated financial
accounting of the collective legal defense fund for the trial sta~e.
In general, 88 counties participated with a total amount received
of $46,186.20. It appears that there will be a shortfall of $4,000
to $5,000 based on verbal communications from legal counsel as to
outstanding bills.

We apologize for the delay in sending this update but wanted to wait
until you could be informed about the meeting time for discussing
an appeal.

Attached is a copy of the Appendix included in Judge Dupree's order
which indicates the assessment level finally established for each
county involved in the lawsuit. This percentage figure will be
used to determine the amount of tax due by the railroads in each
affected county for the 1980 tax year.
