- 2 - the Easement Property for said purposes; and together with the right to cut away and keep clear of said sewer line or lines all trees and other obstructions that may endanger or interfere with the proper maintenance and operation of said lines; and the right at all times of ingress, egress and regress to, over, under and through such Easement Property for such purposes; PROVIQED, that the grant of this Easement is made subject to the following terms and conditions: 1. County hereby grants to Philip Morris and to Board, as their interests may appear, the right to install in the Easement Property a sewer line or lines for the purpose of servin~ the Philip Morris p~operty with public sewage service through an already existing and operating sewer line (the "Existing Sewer Line") owned by County and operated by Board on County land near the County Public Health Building. The exact location of the Existing Sewer Line is more particularly described in that certain Lease Agreement between County and Board dated January 21, 1977 the terms of which are incorporated herein by reference. 2. Philip Morris shall fund and supervise the required engineering and construction costs for the sewer line or lines to be insta'lled within the Easement Property. After completion of construction and inspection, Board shall accept this Easement and the sewer lines or lines for service into Board's sewage system and thereafter operate and maintain s~id the Easement Property and the sewer line or lines ~ocated tkerein in comp!i~nce with'th~ terms 0f this Easement. 3. Philip Morris, subject to the terms a~d conditions of this Easement, shall have the sole right to use the Easement Property for the purposes herein granted and the sole right to use the sewer line or lines to be installed therein.
