CONTRACT BETWEEN THE <br /> BOARD OF LIGHT AND WATER COMMISSIONERS <br /> CONC!)RB, N. C, <br /> AND <br /> CABARRUS COUNTY, N, C. <br /> <br />THIS CONTRACT, Made and entered into this day of , <br />19 , by and between the Board of Light and Water Commissioners <br />of the City of Concord, N. C., in its capacity as Lead Agency of the <br />Rocky River Regional Wastewater Treatment System, hereinafter called <br />and referred to as Board, and Cabarrus County, N. C,, hereinafter <br />called and referred to as COUNTY. <br /> <br />WITNESSETH: <br /> <br />WHEREAS, The BOARD, has caused a 201 Facilities Plan to be prepared <br />for the transportation'and treatment of wastewater from the said <br />facilities planning area, and <br /> <br />WHEREAS, the COUNTY is a participant in the development of the 201 <br />Facilities Program, and <br /> <br />WHEREAS, the COUNTY desires to discharge its wastewater into the <br />regional sewage collection system, and <br /> <br />WHEREAS, the BOARD acting only as Lead Agency is willing to accept <br />and treat the wastewater from the COUNTY into the regional sewage <br />collection system for treatment and disposal. <br /> <br />NOW, THEREFORE, the BOARD and the COUNTY in Consideration of the . <br />mutual participation of each agency in the preparation of the 201 <br />Facilities Plan agree as follows: <br /> <br /> 1. COUNTY agrees to discharge all of its wastewater into <br />the interceptor sewers of the regional sewage system and to pay all <br />user charges in connection therewith. <br /> <br /> 2. COUNTY agrees that the quality of the wastewater that <br />it discharges into the said regional sanitary sewers shall conform to <br />current EPA and State regulations, the BOARD'S sewer use ordinance, <br />the user charge, industrial cost recovery program, industrial pre- <br />treatment standards and other requirements promulgated by the BOARD <br />from time to time. <br /> <br /> 3. The BOARD agrees as Lead Agency to accept the wastewater <br />discharged by the COUNTY into the regional sewage collection system, <br />and treat same at the Rocky River Regional Wastewater Treatment Plant <br />in conformity with other wastewater received, and discharge the treat- <br />ed wastewater to the surface waters of the State. <br /> <br /> <br />
