Mr. Charles D. McGinnis
Page Two
August 18, 1980

(1) The Probation/Parole officer wiil no longer make a request to the
District Attorney that the alleged fugitive misdemeanant probationer be
returned from the asylum state. Rather, the Probation/Parole officer
shall report the circumstances of the particular case to the District
Attorney for whatever action he wishes to take. The District Attorney
will be responsible for filing the appropriate papers with the asylum
state.

(2) We will continue our current practices for returning alleged fugitive
misdemeanant probationers from the asylum state to North Carolina only
after the Pi'obation Extradition Office has been requested to do so by
the appropriate county and after having been informed that the county
will reimburse the Division of Adult Probation and Parole for the expenses
involved in the return of the alledged fugitive misdemeanant probationer.

These changes in policy are effective immediately. Please contact our
office if you have any questions concerning this matter.

Best personal regards.

to the Governor

dC/jh
