RiGHT-OF-WAY <br /> <br />STATE OF NORTH CAROLINA EXTENSION OF ROAD TO <br />COUNTY OF CABARRUS WOLF MEADOW ELEMENTARY <br />TOWNSHIP NO. 2 SCHOOL <br /> <br /> PHILIP MORRIS INCORPORATED, a Virginia corporation, 100 Park <br />Avenue, New York, New York 10017, being the owner of that certain <br />fee simple property and a 60 foot right-of-way as described in Deed <br />dated ~une 19, 1978 by and between Edwin A. Morris and wife, Mary <br />C. Morris, as Grantors, and Philip Morris Incorporated, as Grantee, <br />as recorded June 21, 1978 at 3:41 o'clock P.M. in Book 492 at page <br />698 of the Cabarrus County, N0 C. Public Registry, recognizing the <br />benefits to said property, and to that certain tract or parcel of <br />land owned by the Cabarrus County Board of Education (the "Board of <br />Education") as described in Deed from Edwin A. Morris, et al. to <br />the Board of Education recorded in Book 441 at page 38 of the <br />Cabarrus County, N. C. Public 'Registry, by reason of the North <br />Carolina Department of Transportation (the "Department of Transportation" <br />assuming the responsibility for the maintenance of a road to serve <br />the Wolf ~:eadow Elementary School and to provide access to the. <br />Board of Education property as requested by said Board of Education <br />and access to the property of the undersigned, hereby grants to the <br />Board of Education a nonexclusive right-of-way for said proposed <br />access.road to the Wolf Meadow Elementary School and releases the <br />Board of Education and the Department of Transportation from claims <br />for damages to the undersigned by reason of said right-of-way <br />across the lands and right-of-way of the undersigned and the future <br />use thereof by the Board of Education and the Department of <br />Transportation, their successors and assigns, fo~ all purposes for <br />which the Board of Education and the Department of Transportation <br />are authorized by law to subject said right-of-way; said right-of- <br />way bein~ the width indicated and across said propert~ and right- <br />of-way as follows: <br /> <br /> (1) A right-of-way or easement corresponding to that previously <br />granted to Edwin A. Morris by Luther Monroe Brown, et al. under <br />Deed dated March 12, 1957 and recorded in Book 273 at page 46 in <br />the Cabarrus County, N. C. Public Registry and subsequently acquired <br />by Philip Morris Incorporated under the Deed above referenced, said <br />right-of-way being 60 feet in width the center line for which is <br />more particularly described as follows: <br /> <br /> <br />
