Carolina Association of County Commissioners <br /> <br /> Public Officials and Employees Liability Insurance Questionnaire <br /> <br /> April, 1978 <br /> <br /> BACKGROUND <br /> <br /> Many counties and cities are expressing concern over the increasing <br /> number of lawsuits being filed against public Officials individually <br /> and the inability to purchase adequate insurance protection at reason- <br /> able rates. The North Carolina Association of County Commissioners <br /> and the North Carolina League of Municipalities have been asked by <br /> the North Carolina City and County Managers Association to cooperate <br /> in an effort to seek a solution to the insurance problem as soon as / <br /> possible through attracting a private insurance carrier to provide <br /> coverage. <br /> <br /> Generally, we are exploring insurance coverage which would contain <br /> the following features: <br /> <br /> (1) Insured - all county and city elected officials, all <br /> appointed officials serving on boards and commissions, <br /> all county and city employees, but not the county or city <br /> <br /> (2) Coverage - all sums which the insured shall become legally <br /> obligated to pay as damages because of bodily injury or <br /> property damage covered, including defense costs. Also <br /> covered is "personal injury" which ~nclude: ~mental <br /> anguish, false arrest, false imprisonment, wrongful eviction, <br /> malicious prosecution, libel, slander, invasion of rights <br /> of privacy or discrimination, and certain assault and <br /> battery. Also covered are "errors and omissions". <br /> <br /> (3) Condition - It is anticipated that coverage would be <br /> available at a reasonable cost only if all eligible <br /> officials and employees of a participating local govern- <br /> mental unit are covered (for each local unit which would <br /> elect to participate). <br /> <br /> SURVEY <br /> <br />1.
