NORTH CAR OLINA cABARRUS COUNTY TItlS LEASE AGREEMENT, made and entered into this 21st day 'of January, 1977. by and between CABARRUS COUNTY, l:artY of the first part, and BOARD OF LIOHT AND WATER COMMISSIONERS OF THE CITY OF CONCORD, party of the second part; WITNESSETH: - That whereas, Cabarrus County constructed a new public health building at the intersection of Cabarrus Avenue, West, and Highway 601 By-Pass; and whereas, Cabarrus County owns other office building property at the intersection of said highway; and whereas, the sewage disposal system for said building was inadequate and it was necessary to provide for the disposal of sewage from said building into a treatment facility of sufficient capacity lo handle the same; and whereas, the Board of Commissioners agreed with the Bbard of I,ight & Water Commissioners that the best method of treating said waste was transporting the same by a ~;wer line to the inter- ceptor sewer line bf the Board of Light & Water Commissioners al Buffalo Creek; a~d whereas, it was agreed that Cabarrus County would pay for the construction of said sewer line frora the healtb center building to the inter- ceptor sewer of the Board of Light & Water Commissioners and that the Board of Light & Water Commissioners would accept said line and maintain the same; and that said line would be leased to the Board of Light and Water Commissio.~ers; NOW, TI-IEREFORE, in consideration of the premises and the agreements hereinafter made, the party of the first part does hereby let and lease to the party of the second part a p~rpetual right of way for ~ sewer line and the sewer line which has been constructed on said right of way and prop- .~'~tua~$.w.~t~o~o. erty, said property consisting of the rights of way granted to Cabarrus 80GER & GRAOY .,c0.~.
